There is no official word on 1.09 whatsoever yet. If with "legendary tweaks" you refer to the itemization changes, this won't be part of 1.09 (itemization changes will not occur before Blizzcon, i.e., not before November).

And how do you know 1.09 will be before Blizzcon ?
I don't know, but it's very unlikely that Blizzard won't release any single patch for straight 6 months.
I dunno, they allowed World of Warcraft to go nearly a year without major content patches towards the end of Cataclysm. If they do that for a subscription-based MMO....
They are not working on any content patches at the moment. They are working on new content, but not patches. See lengthy explanations at the following, which are summaries from attendees at the fansite mixer Blizzard held on Friday:
Diablofans was also there, but they don't seem to have commented on this in any of their recaps so far.
Yeah, it's not really that surprising though, honestly.
No developer has ever mentioned that patch or mentioned more content coming soon. This is one of those things that the community invented and then spread around and Blizzard just didn't feel like going out and flat-out rejecting in case they pulled a 180 and needed/decided to Patch before Blizzcon or D3X.

Oh yeah, completely agree that's it's not really big news except to people who invented dream patches (and dream timetables) in their heads. Wasn't meant as an indictment of Dfan's coverage at all - I just meant it as an explanation for why people posting in these forums might not have been aware of it.
They're probably putting all hands on deck to bang out the console version... once that's out and blizzcon is over they'll most likely start up (or continue) 1.0.9.... otherwise the legendary dyes are eating up all of the devs time ;P
Just go play something else for a while and check this site every now and then. There are so many amazing games coming out, and many of them are cheap! As soon as something actually happens or is announced it'll be on the frontpage of Dfans. In the meantime, why not play some Company of Heroes 2?

Blizzard's silence seems strange. I know they're enthusing on the console side of things, but they're supposed to have separate teams for that, so what are the PC devs doing? I'm half expecting there to be a big announcement in the next 2-4 weeks and *BANG* patch with some crazy new things in we never saw coming.

If you actually look at what the fansites are all jointly reporting from that mixer they held on Friday, it's pretty clear what's going on. They never intended for content patches to be as frequent as they have been, but they were necessary because the game was released in a rather poor state. Moving forward, instead of dropping patches every few months, they are instead focusing on major new content (new itemization, expansion content [new class(es), new act(s), etc.]). They are not actively working on a patch 1.0.9, there are no plans on the table for what will go in the next patch, and they don't anticipate any patches before Blizzcon.
Internally, they are probably focused on working on the expansion and associated item revamp, which may or may not come as a free patch before the expansion drops (they have never officially stated one way or the other on this point). 1.0.9 was never referenced specifically by Blizzard, it was something fans invented. I think it's pretty clear that the PC and console teams are separate, as they keep insisting, so I don't think the push to launch the console has any bearing whatsoever on the patches (or lack thereof) for the PC version.
I might even find an upgrade before the next patch/xpack, imagine how long it will be (I'm not that pessimistic, I could have say "Jaetch will find an upgrade before next patch/xpack").
Actually, yeah. Jaetch mentioned this at some point - since there's no new stuff coming in the next few months, upgrades (even if they're expensive) might be worthwhile. I was almost about to agree with ruksak, indimix, and maka in their disappointment/anger, but I'm trying to look at it from the bright side: If Blizzard announces a big game change, I kinda stop working on my characters as "everything changes" anyways. Now I can put some thought into theorycrafting builds or acquiring some gear (for my twinks as well) since it will last for at least half a year, if not longer.
Don't hold your breath, Blizzard's priority is not D3 right now, at least not D3 for PC anyways...
Considering Blizzards PC Diablo 3 teams main focus is D3 for PC, that statements just dumb.
But it might just make some sense considering they're probably not giving us anythingat all (!!!) for the next 6+ months (link).
I mean, I understand that the process to make changes to skills might be more complicated than we give them credit for, but not have anything planned at all is outright disgusting
Ask anyone here, I've been an avid defender of past Blizzard actions (even when I didn't like them, I understood why they were being made). But I simply cannot understand or support this decision. The console version, future patches and expansion will have to make up for so much if we get nothing for the next 6+ months.

I think "dumb" is appropriate for this situation. "dumb" would be leaving a great game with a critical wound for over a year and a half (maybe as many as two years by the time itemization is fixed).
If their resources weren't being drained toward the console, then why is it taking so long? This is what they do, develop games. Most players have one glaring issue with D3, the sad state of items.
If resources were 100% toward remedying this, then why is it taking so long?
This should've been done by now. I feel marketing and "release" logistics have far more importance than you give credit for.
Bliz is going full-bore into the console launch because it represents tens of millions of dollars.
Bliz has clearly placed a priority on acheiving that mark ahead of achieving proper itemization for a game already released, there;s no money in that.
What will happen is that the mythical 1.09 itemization patch will come on the heels of their 3rd chapter of releases for the D3 title, the expansion pack for PC.
We get improvement when it suites their bottom line, period.
Now, from a business perspective, I understand. But as a player, I am nothing short of frustrated.

Everyone knows you are a negative person, Maka.
Would I be shocked?
Yes, yes I would.
