They've seen it. They not only have to prove it against their standards, and figure out how the bot functions so they can block it.
If they just ban every case at a time, that only speeds up how often bot writers find new methods & means to hook into the game.
Banwaves when they are ready to squish a bot is better than just an instant and continual arms race.
It serves no purpose to blindly ban and never address how it works so you can work to prevent it.
Honestly, I can't even understand how they manage to find an elite pack per minute, let alone kill them :/
Waypoints, they probably farm the cave in the foresaken woods or whatever. Guaranteed elite and lots of easy mobs to kill. Videos here show a kill every 20 seconds.
Forgive me if i'm mistaken, but i'm fairly certain Blizzard has to have actual real proof that someone is botting before they can ban them. They can't just go "he haz killed lots of elites.. BAN!!" if it was that simple then no game would ever have botting issues. Every games company that brings out online games has data for all of this stuff and at the same time all these games have botting and hacks running rampent simply because they can't just ban people for killing a lot. Even if that amount isn't humanly possible, it's still not enough just like any case like this your innocent until proven guilty.
You are wrong, read the ToA. There is a clause there that states that they can ban you for whatever reason.
Although if they started banning people for something like them being Hispanic I could see that becoming a court issue, but barring anything obviously inappropriate like targeting a racial group, they can ban for whatever. This would be a good time to exercise this clause ^^
That is correct, but even with that clause they're still going to do what they can do to make their "case" stronger. You see how many people get banned from the b.net forums and immediately come here to make a post claiming they were wrongly banned. And that's just the forums.
Imagine how out-of-hand it would get if Blizzard actually *was* banning people from the game for no reason but just on a gut feeling. The mods here would have to make a whole forum for people who got banned so that they didn't drown out the rest of the discussion!
Step 1: Discover suspicious activity
Step 2: Observe, verify suspicions
Step 3: Determine how bot/hack operates
Step 4: Design and test countermeasures
Step 5: Banwave, enact countermeasures.
Just a quick tip: If you make step 3 a ban, not even in waves, you only tip your hand and the bot/hack folks get the chance to:
Step 1: Determine how bot/hack was detected/tracked
Step 2: Design and test new methods of hooking in to the game process
Step 3: LoL @ blizzard for failing to actually hose you before you could come up with more workarounds because they told you they found your means & methods.
So chill out. They can't just ban willy nilly or they only increase the speed at which bots & hacks evolve, like an arms race.
Except these bots have been running 24/7 for 3 months, and are mostly just autoscripts. They don't hook into the game process, they merely replicate human input.
Can't be hard to ban anyone who is online and playing 24/7 for a week.
You aren't going to catch any legit player on 24/7.
I just wanted to touch on what another poster brought up earlier. It was concerning banning every botter as they come across them, as it turns into an arms race, because it allows the bot/hack program writers the chance to adapt their programs on the fly. This is exactly why Blizzard sits back, lets botters run their course, then drop the banwave on them. Why? It's easy to explain.
Botters, when they test their programs, will test the waters. If it seems successful, they open up a bunch of accounts and let them do their work, padding the pockets of Blizzard with each subscription they sell to them. Trust me, as soon as Blizzard catches on to a botter, they are able to track IPs, accounts, and activities to not only to identify the botting program to kill it, but to identify all accounts using this method. When the feel they have a good hold on it, the bring down the Banwave Hammer and squash the botting program, while wiping out a decent size pool of botters.
It's modern warfare. Think about it. Would you rather:
A: See a known terrorist walking down the street, identify him and cut him down where he stands.....OR...
B: Track said terrorist for a few months, find all the safe houses and terrorist cells he is associating with, and lead a calculated air strike, temporarily crippling a terrorist network until the next one arises?
You have to pick your battles. Being a WoW player pretty much since launch, I can tell you that I have not only seen people banned for no reason, I have seen people banned for legitimately legal exercises. I personally received a temp ban when I traded a large amount of gold to my second account before I had the two accounts merged, simply because my IP address of my laptop(running off my neighbors wifi) and my IP were from different providers, and the large amount of gold being traded threw up a flag I guess. All I had to do was place a phone call, explain the situation, and verify some account information, and everything was cleared up. They were very helpful and understanding.
Point being, they can ban for any reason they want. They have in the past, they do now, and they will in the future, and their ToA wording assures us of that. Yeah, it might take time, but they are constantly working on snuffing out botters and their programs. It's easy to sit back and criticize them from the bleachers, but without knowing all the facts and their procedures, try not to play the "i can spot a botter better than you can" card.

Don't talk sense. The majority of people in this thread have no understanding of how this works nor are they intelligent enough to realize that Bliz does in fact do almost exactly what you said, they always have. It is exactly how they take care of WoW botters and they have told us so on many occasions. Unfortunately the PMSing masses would rather whine, bitch, and cry instead of accepting the truth of the matter. The truth being that banning botters on a daily basis will only make shit worse.
It's modern warfare. Think about it. Would you rather:

I understand your point, but in this case, the 'terrorists' are comitting terrorist acts while they are being whatched (i.e., Blizz might be watching the botters, but they're still doing their botting and fucking up the economy).
And you don't think that is how it works IRL with actual terrorists? You're cute.

Don't you dare come in here talkin all that slick city boy common sense.
Well, I spent weeks on diablo and finally payed off the game so to speak making 50 euro in the real money AH.
Then my friend comes along, buys diablo, gets a bot from another friend and starts botting act 3 hell.
He is online 24/7 and told me how it works. I cba to listen to all his laughter how he is owning and making gold while sleeping so in my rage I report him (don't care if he is my friend, cba with botters), making 2 tickets. This was a week ago haven't heard from blizzard since and he is still making gold / selling it on the RMAH making money for not doing a thing while I had to farm for weeks.
Are they even banning botters or just totally gave up?

Thanks. My GF thinks so, too.
However, this is not about what happens, but what should happen. Maybe if your family gets blown up and you find out the police were following the guy who did it but didn't stop him, you'll change your views. Maybe you can be cute too.
GF huh? *rolls eyes*
lol seriously though, I agree with Maka. The big difference between the two examples is following the botter won't lead to any big breakthrough. Blizzard can see them all (at least the obvious ones) and stopping them right when they find out is the best option. Now of course there is litigation to go through to ban someones account, especially when it's tied to moving around real money.

Would I as a victim be angry? Of course, what moron wouldn't. But would I find my personal loss to be easier to deal with when I find out as a result they captured several major terrorist cells? Of course I would because then thousands of other people will be allowed to live.
You talk as if you understand what the real issues are yet you don't. If Blizzard were retarded and did weekly bans the people using bot programs and scripts would only update them faster thus making them harder to track thus making the problem harder to deal with. This is common sense, not something you have apparently. By waiting and rounding up thousands upon thousands of names they will effectively neuter the organizations using these bots and scripts while taking millions upon millions of gold out of the system. Quite a brutal hit to the pockets of these scumbags.
Do I agree with these assholes using scripts and bots? No. Do I agree with how Blizzard handles them? Hell yeah. Do I wish Blizzard could or would do it faster than they do? Of course. But I am not going to get on an unofficial forum and cry and whine like a baby over it. Anyways, what kind of melodramatic moron compares gold botters in a videogame to terrorists in real life? Little out of whack with reality eh?

Spoken like someone who has no clue what they are talking about.
Blizzard won't ban anyone without proof of having actually cheated, and logging a ton of hours in a game is not proof of hacking. They track the programs being used to interface with the game. even scripts are traceable. They need to figure out how to trace them, then they go along and write up a program to run through their server to track all the scumbags. Yeah, they could ban them one by one and then the writers of the bots and scripts and such find out and start updating right away so then bliz has to like automatically start trying to detect a new program version. Instead they take several month rounding up all the people using the shit and ban them all at once annihilating their accounts and attached accounts. When they do that they are taking billions of gold out of the system as well because lets be honest, these accounts are going to have tons of gold.
Doing it your way is stupid and just makes them have to do infinitely more work, almost an impossible amount regardless of their resources. Doing it there way is what works, and is what most other game companies do as well. You allow the "bot" to spread to more and more people. The longer they don't ban the users the more scum they will eventually get to ban the more illegal gold they will be taking out of the system. I don;t see what is so hard to understand about this.
Have you actually clicked the link and followed the instructions??
You say it isn't proof they are botting, but they have 24/7 uptimes, not tons of uptime, not logging alot of hours, they have LITERALLY been online 24/7 for 3 months.
24/7 uptime.
They are all 90% in blues.
They are all only upto Hell Act 4 after 3 months.
They are all in GF with as much pickup radius as possible.
Read the OP, follow the instructions, then come back here and justify their elite kills/play time.
Or just fly off the handle and decry everyone as idiots.

Yeah. Obvious bots. 225% GF, 43 yard pick up radius. ~390,000 Elite Kills. Hasn't finished Act 1 inferno. Obviously just bot farming.

Americas. Monk with chinese characters in the name.264% GF, 33 yard pick up radius.
200k E.K. / 3 = 66,667
130k min / 66,667 = 1 kill every 2 minutes roughly
Forgive me if my math is off...my brain is fried from work
Waypoints, they probably farm the cave in the foresaken woods or whatever. Guaranteed elite and lots of easy mobs to kill. Videos here show a kill every 20 seconds.
A lot of the DPS is bugged out. He can have like 6 different Buffs that make his DPS huge.

Blizz has the tools, but not the gumption to get rid of this plague on the game.
