Hey there, I am a fan of blizzard or maybe I should say I was, yet I am still a fan of Diablo itself, and I'm trying to get back to my game.
it was last Saturday when I woke up in the morning and found my account banned. it really confused me, and I've been spending my last week ticketing with them trying to find out why. they were just replying that I have violated their policies and close my ticket, I finally got a confirmed word "botting" after the whole week.
while in the matter of fact I did not do it. but after then no matter what I have followed with those tickets. they just ignore and worked really hard to close/cancel my tickets. seemed so confident to have evidences. while I would have moved away if I was botting.
thinking it through, I am a man who's doing software jobs and eager to learn about excellent programs, and I actually managed to get some botting code to read. I never intend to use it and it actually did not get the chance to run,
these are inactive codes just laid there for me to read. if they have got solid evidence about me botting indeed, it is the only possibility that they have scanned my filesystem and found such bits. while even my anti virus software don't scan inactive codes. I suppose this is a spying activity from blizzard, they are violating my privacy and trying to kick me out of the game!
asking about this "privacy" question, I at first was expecting a simple answer maybe like "no we didn't", but in fact they've been avoiding this question all the time and there was not a single word for it all all.
I respected this game and never tried to hack it, I just tried to learn from that program to improve myself for a simple reason that this is the only one which I know for sure is doing good.
There are enough bots running on the server that we can tell. some of them even are so obvious advertising or whispering selling gold, they don't do nothing about them and banned me instead, how ridiculous, I spent more than a week to reach 20 paragon level, is that what a bot do?
anyone got any ideas of what can I do with these non-supportive support group, and about our own filesystem security. is that the only way that I need to turn to legal help? it could be hard while I think I need to keep fighting with them/
And what I said is entirely true, why would I spend my time to lie here? even if I could get benefits cheating in game. there won't be any here at all.
I have played a lot in the past year and have characters of all classes equipped and have 3 billions of gold, in EU, I just left them there (I don't deal with the real money AH at all )and not intent to go back before I recently moved to US server and had a fresh start with a single monk reaching level 20 in less then a month, it's not a big deal to start again with another less than $50, these arguments have already cost me more than that and I've been spending my last week sticking with the login window, I do this for my right.

Easy body. there are lots of IT guys out there cares about technical details more than the program itself.
It's so easy to prove that I did not bot the game, I've got 2 computers which I usually play D3 on, which are Server2012 and WIndows8, and I had this code only in my windows8 PC to view, not enough test to support but I think it's because of windows8 compatibility, this code is not even runable in my PC, I did not do any further trying and investigating since it doen't prevent me geting the knowledge.
Well, technically speaking, if you didn't bot, what you do in your free time with harmless code is up to you, and they shouldn't assume that you are going to use that code for botting. It's like sending a man to prison because he was studying a gun, and he could probably use it to kill someone.
That is, if and only if you didn't use the bot, of course.
Anyway, there's absolutely nothing someone can do for you. There's 2 ways of solving this, and one seems to not be working for you (you claim to not be getting satisfatory answers... I'd ask for a more complete answer). The 2nd way is filing a lawsuit asking for a refund or having a judge order them to unban your account (never heard of anything like this, though, so I'm not even sure if it's possible). Obviously, you can only follow the second path if you can prove you're 100% legit (and it's more likely they can prove otherwise).
But again, this is very weird. The whole "I had codes and they were running in the background and they were for botting but I swear I never used them and I swear it was me playing for 50 hours straight..." doesn't sound good to me.

BTW, I believe there are a lot like me who's interested in such programs not for the hacking part but for the operating, since this program combines and cast skills like a human thinking, that's what' amazing.

If you think they're not going to ban someone running a bot because they weren't online 24/7 then you're probably naive enough to think that they're going to feel sorry for you because you were running a bot for "educational purposes."
You REALLY should have thought for a day or two how it would look to Blizzard before you went head-long into this. If I were Blizzard, even if I believed your story, I wouldn't reverse the ban because the whole "I didn't know running a bot for educational purposes was wrong" thing just doesn't make sense. Running a bot for ANY purposes is wrong.

I detect a high level of hate against the OP, I wonder where does it come from, maybe dedicated players have a serious amount of hate against botters.. still, if he said that the project never ran, why are you not believing him?, Blizzard could perfectly scan his HD and find certain files that are flagged as botish material. Who knows.

If you downloaded a bot's binaries onto a machine that you play D3 on... that's a paddlin'
If you did something seriously daft, like make a little test program that uses the same API hooks as the botting code... that's a paddlin'
AFAICT Blizzard doesn't have a 'minimum time' for bots... running one for 60 seconds or 60 days makes no difference if you get caught. Also, you seem to be a little hazy about the difference between binaries and source code... only one of which you can poke around in with impunity. Messing around with grayware has inherent risks.
Your main problem, though, is that the story you're telling is basically identical to what Blizzard has no doubt been told by thousands upon thousands of actual botters. Your second main problem is that Blizzard has very good reasons for not being forthcoming about how they detect botters. IMO, eat the $50 and move on.
Not that I believe OP's story (I'm leaning towards 'no'), but this exemplifies the "punish the saint for the sinner" type of policy that has been going on in Blizzard (and elsewhere) for a while, now (legit players suffering just so they can stop illegit ones). And I always thing that's a bad policy.
Depends on the false positive ratio, doesn't it? Unfortunately, that's information that's doubly impossible to get. Blizzard won't tell us how many people get banned for botting or how many people (if any) get those bans reversed, and there's really no way to tell how many permabans are given wrongly.
IMO, the mitigating factor for any such system is that it's not completely arbitrary. We know how to minimize risk and there is an appeals channel (although again, there's no way to tell how 'fair' it is). On top of that, AFAIK it's only a key-ban... they don't nuke your entire BNet account.
You can't take legal action because you agreed that they can perform (limited) scans of your system. It's right there in the ToS and has been since before D3. I remember when they updated the ToS during WoW days.
