Yes... But you do still fight Diablo as a boss in that game. My sort of view on Diablo III is that it's going to be the "final" fight against evil type of game. A hero is required to actually go into Hell somewhere in the game and eventually destroy some sort of force that keeps evil thriving. Perhaps while in Hell they would need to fight Baal, Diablo, Mephisto, Azmodan, Belial, etc.
But it's only because you can't fight the same guy twice in one game (exception of Mario), it's lame. So the original Diablo 2 already had Diablo, so they needed someone else.
But if he isn't the final Boss, then He would have to be the second to last Boss, much like he was in LOD. But that would mean you would have to have someone who's power exceeds Diablo as the final boss, and that limits the choices (as far as I know). Baal have more potent spells errr.. at least he is suppose to, the most plausible choices are either Belial and/or Azmodan, as we really don't know that these two have been up to since the rebellion in Hell. They are now the most powerful demons know to exist, Andariel, Duriel, Izual, Mephisto and Diablo are no longer among the living. There is probably some other powerful novel only demons that could make the transition to game demon, and I wouldn't mind that, but we will have to see what happens.

Perhaps since he is a demon he is reborn in Hell. Maybe your character will venture down to hell to finally destroy him and all posibilities of him coming back.

It's the decisions you make when you have no time to make them that define who you are.
I think it would be cool if in the end you have to fight something along the lines of-
A. The 3 Prime Evils conjoined by someone taking a hold of all three soulstones.(They could twist it so you only THOUGHT you destroyed Meph's stone and D's and B's stones were never actually destroyed. Say a minion took Meph's stone and that's why he was so easy to kill.. Cause meph is supposed to be the strongest b ut for some reason he dies first. And whoever was supposed to destroy all 3 of them decided to take them and attempt to control them much like the ending of D1)
or
B. Who's their father? Wouldn't it be cool if there was a backstory behind it? Somehow the father of the three prime evils is resurrected or awoken using the three soulstones? Then the final boss is one super bad ass mofo?
The ideas are slightly cliche, but I think they could work.

plus DIABLO II: LOD , the boss is baal...not diablo.
But if you want a boss besides Diablo I'd have to go with...Tyrael or a combination of all the Prime Evils.
