I am amazed at the fact that I have clearly posted a fix on this same page and yet there are 2 more posts directly after mine who still ask for a fix?

I'm having the exact same issue the original poster in this thread had. I have Win 7, and can't get the 109 patch to work. Game color problems are the least of my worries right now. Was there a fix for this? I read through all the pages and don't see one.

I also tried to connect to battlenet, and cannot. So, no way to get the patch. However, I started a single player game, and my colors look fine.
Wanted to initiate my son to Diablo via multiplayer. Really hope someone can tell us how I can get the patch, and how we can play multiplayer now. I've read enough to know that IPX isn't going to work with Windows 7. So, I guess I need to be able to connect to Battlenet. Unless there's a way to get IPX.
Edit 2: Still waiting for answers. Hans was helping me a bit, and mentioned Win 7 needs the NT patch. Still doesn't work. Get this message, when try to run patch:
"This program is used to upgrade programs through battle.net and does not need to be run"
Right click on the patch program and click compatibility. Check "Run this program in compatibility mode for" and choose Windows XP (Service Pack 2). Then check "Run this program as an Administrator" and hit OK.
This should let you run the patch, after which Diablo will have crazy color problems.
To solve the color problem, right click on your desktop and choose "Screen Resolution." Just leave that window open and run Diablo. Don't know why this works, but it does.

As SpiritusSanctus7 pointed out, changing you're background to solid black, reducing the screen resolution (right click on you're desktop and choose "screen resolution" to access) all the way down (I used 800x600) and right clicking on the (Computer//Local Disk(D:)//Program Files (86x)//Diablo) diablo.exe (I also did this to BNUpdate & VidSize) selecting properties, then going under the compatibility tab & checking the last 3 boxes (Disable visual themes, Disable desktop composition & Disable display scaling on high DPI settings) does work if you are trying to get rid of the coloring problem for Diablo created by Windows7. Also, do not forget to check the box "Run this program in compatibility mode for:" then select from the drop down box "Windows XP (Service Pack 3)". Lastly you are going to want to check the box at the bottom under the heading "Privilege Level" putting a check in the box marked "Run this program as an administrator".
I wanted to add this: If you wish to play Hellfire and you are having the same coloring issue like I was, I found a solution. First, you are going to want to use a black background and lowest resolution setting you can, again. Next, go under you're C drive (Computer=>Local Disk(C:)=>SIERRA=>HELLFIRE then right click on the hellfire.exe icon, select properties, choose the Compatibility tab & once again run this in compatibility mode for Windows XP (Service Pack 3) and run as administrator. However, instead of choosing the last 3 boxes (as you did previously) you now want to choose the first 3 & the last one (Run in 256 colors, Run in 640x 480 screen resolution, Disable visual themes and Disable scaling on high DPI settings) so, the only thing that should NOT be checked is "Disable desktop composition". After I played around with this program for a long time, I finally found a setting that was able to work correctly! I hope this spares you of the time and headaches it cost me. Happy hunting all

didnt they add a free update on Windows Live that makes Windows 7 fully compatible to some older applications?
i remember Diablo 1 and Hellfire being in the list, among other retro games.

What would really be nice is for blizzard to release an update for Diablo 2 and Diablo that would fix these issues. I mean setting my background to black is not that big of a deal but leaveing it that way for a months kind of gets, blah! Then again it might be a big problem for blizzard to fix and not worth their time. I would love to see an option to buy a digital version of Diablo and tie it to my battle.net account. Then maybe they would update it.
