Yeah, thanks everyone who answered me! I fear asking "dumb questions" on forums because people can be jackholes, but you all rock. Either that or we're all just high on excitement, haha.
ERROR: The file "..... Installer Tome 3.MPQE" could not be opened, because an error 108 occured. If this problem persists, please contanct Blizzard Technical Support. (OpenArchive::Execute)
anyone else having this problem? Any ideas what this can be? Any ideas how to fix said issue?

Likely caused by you stopping the download of the installer and then restarting it splitting your Tome 3 file. Delete the Tome 3 file(s) and then restart the installer install. Do not interrupt it this time.
I merged many threads on the install/update issues into this one.
There is a lot of traffic at the moment on the servers because everyone is trying to activate the game and download the patch, most of these issues just requires patience and a few more tries.
My installer had an error where it said "could not open" at Tome 3.MPQ :/
had the same problem.
i took a look in my Diablo-III-8370-enGB-Installer folder.
there i saw that Installer Tome 3.MPQE 0 mb big.
and right beside it i found a Installer Tome 3.MPQE.tmp.
renamed the last into Installer Tome 3.MPQE, restarted the installation.
must have been an issue while downloading the installer tomes.
I had the same issue, but for Installer Tome 2.MPQE
There was a Installer Tome 2.MPQE 500MB~ and a Installer Tome 2.MPQE.temp that was 4.5GB
I tried renaming Installer Tome 2.MPQE to Installer Tome 2.MPQE.backup
and renamed Installer Tome 2.MPQE.temp to Installer Tome 2.MPQE
and I was still getting the same error.
For those having problems with installing (Tome 3 Error) What i did to fix it was i deleted the whole Diablo Directory, went to Battle.net and downloaded the US verison and its now installing perfectly.
I think the most important thing from Bash / BLizzard so far is, if you have found your self needing to re-run the downloader make sure of the following:

Everything installs to 100%. Click Play and then it just sits there at LAUNCHING... below the update bar. I've force quit agent.exe as well as Blizzard Launcher.exe, rebooted, etc. and still can't get beyond this. Any assistance would be welcome.
I started the install about 11:35a EDT without issue. It ran fine, updated and installed normally. Got to see the opening cinematic and now ready to play -- LET ME IN!

The installer folder you download is 7.6 GB, once that is complete and you run the install, the actual game folder is 7.8 GB. So you will need ~15GB to fit them both.

yes me and my friend get this error I re-download client. Have also performed fix disk permissions all is ok.
