I quite like this idea and seems to be loophole free.
Other ideas I have are:
-Perhaps when you die, and collect your corpse your max health and/or mana are reduced by 25% or something (as you JUST died...) this debuf is on a timer for X seconds upon which you fully recover.
-Gold or Random items from you inventory can be taken from the monster(s) that killed you. When you recover and kill the monster(s) they drop your item. In multiplayer games, your items should only be visable for you to collect to avoid other players simply running by, killing the monster(s) that killed you, and then taking your item.
-Slower movement debuff for X seconds after corpse is collected.

I see your first point about health death penalty happening over some other kind of penalty because its cheap and will likely come from WoW...75% reduced stats for 10 min. I do not care for it though because it stops game play which is stupid.
The second point, I do not like either, unless you make it so that the monster that picks up your item glows a certain color so you can differentiate it from the rest, otherwise you have a couple dozen mobs that all look the same and you don't know which has your item. Some people might want to kill all the mobs, but there might be people who just want to kill the 1 that has their item and move on.
As for the last point, if they balance the speed of characters and monsters this would just be an added gimp the character, go afk for the amount of time on debuff. I really like my idea of kill X number of monsters to get rid of debuff, but it only works for debuffs that wont gimp your monster killing ability.

I like the idea of monsters taking you equipment; Like in the Illiad when the Greeks would quarrel over a hero's armor. Spoils of war FTW. Only problem would be getting your gear back empty-handed :/ Maybe they only steal a bit of your stuff?

Yes this would have to be 1 item taken per death, if it was multiple items per death, especially your weapons/shield then the possibility of not being able to kill anything comes into play.
i like the loss of gold and durability idea and doing a corpse run the loss of a item could be bad because you can get to a point of not killing anything but what happens if you die than gets disconnected or have to log off be for you get your item??

This is very true, and a very good reason not to have monsters taking items on death.
