I hate to have to point out the other critical flaw in this suggestion.
Unless Blizzard makes the items soulbound... all limiting these items from going onto the AH will do is force people to use third party websites to buy inferno gear... which kills the ENTIRE point of the RMAH in the first place.
Why do you think blizz are making these crazy looking , hard to get weapon and epic gear? Make more money off the RMAH .
I have no doubt that inferno weapon will sell for 500-1000 USD for a while . Windforce used to sell for 300-400 USD on ebay back when LoD was released .
I don't care about e-peen, can I sell my Inferno found items and make some money out of it?
The RMAH will only give a small fee to Blizzard and the 3rd party site they'll be working with and the most part to us players. I'm not complaining.
I could be wrong, but i thought the hidden match making ranks were from win/losses only, not gear. Is gear also a factor? doesn't make sense, considering I could be a brilliant pvper, pop on some bad gear and keep smashing lowbies for fun.

And you wouldn't even be able to take the "legit" better geared people matched against the rich boys anyway, so the matchmaking system should work fine independent of who is using the gear, the guys who found them or the rich boys that bought them from the guys who found them.
Unless you think this will increase the volume of trades, this is completely inaccurate. Flat fees don't go up with difficulty level. If anything, inferno creates a smaller loot table of items that will hold value significant enough for the RMAH, meaning fewer potential transaction fees.
Gear does not equal skill, but even then I suppose some people don't like the idea that all of their hard work can be overshadowed with a few bucks, then again I would say a guy who worked for it all would have all the achievements and the banner cosmetics as compared to someone who just straight up bought it.
In the end, the guy who worked for it all will still get more out of it than the guy who paid for it.
I think many of you are overreacting with the whole RMAH thing. I don't think there will be that kind of civil war against players-who-buy (PWB) and players who get loot (PWGL). I expect that people will only buy end-game gear, so you have the WHOLE game until Inferno free of PWB. Then you can see that there's no free items, each item bought is an item dropped, so there is no real difference for the PWGL if they are playing with the PWB the item or the PWGL originally. (I'm highly considering that end-game loot will have end-game requirements, so every PWB will have to be high-level, so no "skill" problems)
Also, you should stop having the strong desire that the only people allowed to have the best gear is the people who spent time getting the loot. What if there's a real lucky guy who got the best loot quickly, in like 2 days? Is he any better or worse than the one who spent months trying and didn't get that loot? Or the one who bought it? The drops are random, is the randomness what decide who is better than whom?
There will be no flood of items, so that change absolutely nothing in our PWGL lives.
I know every time I see someone with better gear than me in a video game, I instantly assume that he has a razer naga and some military grade internet connection I haven't even heard of yet. That's why instead of expecting game designers to market their games away from people who will supply more money for them, I made a deal with Ryuk,the Shinigami from Death Note. For the small price of half of my remaining life I can see the amount of money any online player spent on his gaming rig and/or items from the RMAH. Now if only I could discover a means to administer a heart attack to people who do absolutely anything "retro", watch the TV show "Jersey Shore", or make any reference whatsoever to anything being "emo."
I believe Blizzard said they wouldn't have character sales on day one and will be implemented later on. So I think you will still have a sense of accomplishment or achievement if you hit level 60 and start running Inferno difficulty. I'm not sure how it was during D2 release, but there will only be so many high level items for sale and only so many people that would pay the amounts asked. Chances of you running into that person is pretty slim so you might not even know that Windforce 2.0 dropped and was sold to some one.
I do wonder if prices will be lower since there it's off the black market (3rd party sites). Players will all have access to the auction house and be able to buy/sell legally.
