Ok...I have done a few google searches to no avail. I can not find an answer to this question (maybe no one really knows).
My question: Are unidentified items preset with stats before identification occurs?
I have seen responses from players stating that they believe stats are preset but have never seen concrete evidence (e.g. a blue commenting on this or it being written somewhere officially).
Opinions are fine but does anyone know for sure or have a link to a blue post stating how unidentified items really work?
I am sitting on a few unidentified legendaries in hopes that identifying them after 1.0.3 hits will allow them to be buffed but do not really want to sit on them if the stats are preset.
are existing un identified legendaries going to be upgraded?
No, identifying doesn't roll items. The item is rolled when it drops. Identifying it is just the 'opening a present' ritual. (Source)

That is your testcase, right there! Wait after the Legendary Patch to identify them... If they reveal as the buffed one, stats are allocated on ID, if they are the old version, then stats are allocated on drop.
*Opinion* I assume that the stats are determined when the item drops. Since the item drop system works the same for all items in the game, Magic Items stats are determined when the item is dropped. So I would assume it's the same thing for rares and legendaries.
Yes, their stats are already tied to the item, you just can't see them yet.
Legendary item buffs will only apply to new DROPS, not new identifies. You better identify and try to sell them now, rather than after "1.0.4" (Legendary buffs will NOT be happening in 1.0.3 like previously thought, just using "1.0.4" as a reference to a future patch beyond 1.0.3).
Or you can keep your unidentified items and sell them unidentified when they get buffed. It's a lame thing to do, but I'm sure a lot of people is saving up.

If Bashiok stated that the stats are already set in stone regardless of being identified or not, why would selling them unidentified matter (besides the obvious gambling theme)?

I don't think you can sell items unidentified on the auction houses, so you'd have to do in-game in-person trades. And... I bet people will be rather skeptical of why you won't ID the damn item. Maybe it you hide it away for 6 months and try then. But, there's a sucker born every minute, so, best of luck on your minor-virtual-con-artistry!

People have bought un ID items since forever, and if you sell it after you could get probably at least what you'll get for it now ID'd with a great roll because the buyer thinks it can roll the new stats. Shady and unethical but also almost completely undetectable.
