Are you equating the cognitive skills of a five year old with that of a 12 year old...? Sure sounded like it. A 12 year old understands death, I'm sorry but they do. A five year old playing with a gun? I might could see that argument. But when a 12 year old goes and gets the gun, chambers a round, walks up to someone else, and pulls the trigger, you can't tell me that the only thing they didn't comprehend was what was gonna happen when that bullet struck the person. That's total fallacy. And as to conceptualizing "right" and "wrong". That is done even before you learn to speak, so whether or not they experience the "big picture, what is the meaning of life" implications of what they just did, they know what they did was wrong.
Exactly. He chambered the round, aimed and pulled the trigger. He knew exactly what he was doing. I also believe that 12 year olds nowadays have a good understanding of death. Might not have when I was a kid, but they do now. It's all around us. Between war, video games(yeah I said it), natural disasters or whatever, they understand what death is.
For some reason, I was under the impression that there was a distinction between adult and minor for a reason. Looks like I was wrong. 12 year olds are adults now people!
There is still that difference in the eyes of the Court system, but under certain circumstances, even those revolving around murder, everything changes depending on the severity of the crime and if it is warranted for such a change. If there is circumstantial evidence that proves that it was pre-meditated and planned, because of the calculating that is involved in this, he can be tried as an adult. Because he is showing the thought process of that of an adult.
A 12 year old beating his brother to death just shows nothing but rage and anger. But even though his anger and rage was probably directed to someone else it should not have been taken out on the 2 year old. If the mother or whomever knew of his violent tendencies, then they should have dealt with it sooner.

I don't see the act of shooting someone in their sleep something that displays the thought process of an adult. If anything it displays the thought process of a child. If he was an adult he would have waited until his parents were supposed to go on vacation. Then, the night before, he would have walked in with a pistol and blew out their brains at an angle with the least amount of splashing blood for the investigators to find. Then he would have taken the sheets on the bed and wrapped them in it. Then, put the bodies in a garbage bag. Then, load it in the trunk of a car, take it out to a lake and cement their feet and drop them in so that the bodies wouldn't be found and then go back home and put on a nice pair of new sheets. And of course, that night he would have an alibi so that he wouldn't even be considered as the suspect.
THAT would display the thinking of the adult. But what did this kid do instead? He didn't plan ANY of that out. He just wanted them dead. That doesn't seem too far from a 12 year old simply beating his brother to death.
He is a child. Therefore he should be convicted as such.

When someone commits murder, they too just want the person dead. And a lot of times they don't plan it out in that much detail. The fact of the matter is that he still killed his parents in cold blooded murder. The very people that took care of him. Loved him. Provided for him. Not only does he have to live with the fact that they are gone, but also the fact that he took their lives and still should be punished for it. So, are you saying he should just spend time in juvie for it until he's 18 then get out? An adult gets longer for that exact same crime.

They get a harder sentence because they are adults. He is a child. You are bringing personal emotions in this when there is no need for them. Yes, they were his parents and he murdered them. It's very tragic. However, that should have no bearing on whether he is or is not sentenced as an adult. Facts should determine that; such as motive and method. He is still a child and didn't exhibit anything(to my knowledge) to suggest he has the maturity of an adult.
While I do not personally believe his life will turn out very well if not sentenced to life in prison or death, I would not want to be the person to make such a judgement for a child.

You're right, I'm bringing personal emotions into this as a parent. If it were my child, I'd expect the court to make the right choice for course of punishment. I'm also not saying he should get the death penalty either. Just that he should be tried as an adult because of the severity crime.

Agreed completely. Society is largely responsible for the generation of many of these crimes, them being able to punish never made sense to me and probably never will.
And I will say this again. If you want to try a 12 year old as an adult I demand that:
12 year olds can drink.
12 year olds can smoke.
12 year olds can join the army.
12 year olds can have sex etc.
12 year olds can receive financial aid separate from their parents if they live alone.
12 year olds can disassociate from parents.
12 year olds can work full time jobs.
12 year olds can own and carry guns where allowed.
12 year olds don't have to go to school.
If you can't let all that happen... try him as a kid, please, because you are already treating him like one with all those things above. Saying he's a kid that can't handle X, Y, and Z, but then when shit hits the fan changing your mind is disgusting.
There are two sides to the thing. A 12 year old, basically speaking, is mature enough to distinguish right from wrong. He's mature enough to know that you should never murder anyone, but is stupid enough to have a taste of an alcoholic beverage, try smoking, or do something minor like that. If he were to choose to murder someone, he should be tried not as an adult, but a person who knew that murder is something completely outlawed, yet still did it. He requires a form of punishment that is just as devastating as prison in terms of loneliness and isolation, but not so much that it destroys any prospect of rehabilitation and any chance of a good, healthy future that the kid might otherwise have.
