Two illegal aliens, Ralphel Resindez, 23, and Enrico Garza, 26, probably believed they would easily overpower home-alone 11 year old Patricia Harrington after her father had left their two-story home.
It seems the two crooks never learned two things: they were in
Montana and Patrici a had been a clay shooting champion since she was nine.
Patricia was in her upstairs room when the two men broke through the front door of the house. She quickly ran to her father's room and grabbed his 12 gauge Mossberg 500 shotgun.
Resindez was the first to get up to the second floor only to be the first to catch a near point blank blast of buckshot from the 11-year-old's knee crouch aim. He suffered fatal wounds to his abdomen and genitals.
When Garza ran to the foot of the stairs, he took a blast to the left shoulder and staggered out into the street where he bled to death before medical help could arrive.
It was found out later that Resindez was a rmed with a stolen 45 caliber handgun he took from another home invasion robbery. That victim, 50-year-old David Burien, was not so lucky. He died from stab wounds to the chest.

MONTPELIER, Vt. — A man who says he bit into a Burger King sandwich and found an unwrapped condom inside has sued the owner of the restaurant.
Van Miguel Hartless, 24, of Fair Haven, said Friday he bought the Southwestern Whopper at a Burger King in Rutland on June 18 and made the discovery when he got home and started eating it.
"My third bite into the burger, it was just a foreign taste," he said. "It was a very sour, bitter sort of taste. It almost had a numbing sensation.
"As I went to bite down a little harder, I felt a rubber grind in between my teeth. I saw it half in my mouth, half hanging out. It was an immediate sick-to-my-stomach type of thing."
Hartless said he waited three weeks before contacting an attorney. His lawsuit, filed Nov. 16, names store owner Carrols Corp., of Syracuse, N.Y., and seeks damages for pain and suffering, emotional duress and medical expenses.
Messages left with Carrols Corp. were not returned Friday. A spokeswoman for Burger King said it has referred the matter to Carrols Corp.
Similar claims have turned out to be fraudulent in other cases. A California couple was sentenced to nine years in prison in 2006 for planting a severed finger in a bowl of Wendy's chili in a scheme to extort money from the fast-food chain.
Hartless, a student at Green Mountain College, defended his claim.
A search of court filings in Rutland Superior Court — where Hartless' suit was filed — and the Civil Court in El Paso, Texas, where he lived before showed no prior or existing lawsuits, according to the Rutland Herald, which first reported the lawsuit Friday.
Hartless' lawyer, Devin McLaughlin, said he had Hartless undergo a lie detector test before the suit was filed, and that he passed "with flying colors."
Hartless said he has suffered from vomiting, nightmares and emotional distress. He said he also has incurred medical expenses, because he's worried about whether the condom had been used.
He said stored the sandwich and its original wrapper in a plastic bag in a freezer in his garage.

I don't understand the pain and suffering, emotional duress and medical expenses. He bit into a possibly used condom. Why would he need medical attention. It's disgusting but still.

NIAGARA FALLS, N.Y. — A judge who jailed 46 people who were in his courtroom when a cell phone call interrupted proceedings was removed from the bench Tuesday by a state commission.
Niagara Falls City Court Judge Robert Restaino "snapped" and "engaged in what can only be described as two hours of inexplicable madness" during the March 2005 session, Raoul Felder, chairman of the state Commission on Judicial Conduct, wrote in the decision to remove Restaino from the $113,900-per-year post.
A phone rang while Restaino was hearing the cases of domestic violence offenders who had been ordered to appear weekly to update the judge on the progress of their counseling. A sign in the courthouse warns that cell phones and pagers must be turned off.
"Everyone is going to jail," Restaino said. "Every single person is going to jail in this courtroom unless I get that instrument now. If anybody believes I'm kidding, ask some of the folks that have been here for a while. You are all going."
When no one came forward, Restaino ordered the group into custody, and they were taken to jail, where they were searched and packed into crowded cells. Fourteen people who could not post bail were shackled and bused to another jail.
Restaino ordered them released later that afternoon.
Restaino told the state panel he had been under stress in his personal life.
His attorney, Terrence Connors, said Restaino would appeal.

Florida woman charged with being married to at least 10 different men

MIAMI - The honeymoons are over for a 26-year-old woman who authorities say was married at least 10 times.
Eunice Lopez has been charged with bigamy, accused of marrying 10 men between 2002 and 2006 without divorcing any of them, federal immigration authorities say. The Miami Herald reported Saturday that a records search by the newspaper found seven additional marriages under the bride's name and birth date.
Lopez arrived in South Florida from Cuba in 2002 and was a legal U.S. resident.
"I can tell you that none of the individuals she married had any type of residency," said Terry Chavez, a spokesman for the Miami-Dade office of the state attorney.
Prosecutors say she charged her husbands an unspecified amount to help them secure immigration status and continued asking the men for money long after the wedding, threatening to expose them if they didn't pay.
Chavez said the state attorney's office began investigating after being tipped off by Immigration and Customs Enforcement.
Lopez was released on $18,000 bond. Her last known address was in Hialeah, just north of Miami. A telephone listing for her could not be located, and it was not known whether she had an attorney.

This could be a serious medical problem. If for some reason the man had open wounds in his mouth or if he had open wounds in his stomach such as from ulcers then sexually transmittable diseases could have easily been contracted from a used condom. I can also understand emotional duress because if you bit into a condom that was in your burger you would feel many different emotions such as embarassment, anger, fear these are valid arguments in my opion, the pain and suffering I don't know so much about.

Military officials told NBC News Monday that two U.S. Navy destroyers and one frigate were heading into the Persian Gulf through the international waters of the Strait of Hormuz when five armed "fast boats" of the Iranian Revolutionary Guard approached a high speed, darting in and out of the formation.
At one point a radio message from one of the Iranian boats warned, "You are going to blow up within minutes."
The Navy warships went into defensive mode, radioed the usual warnings to steer clear, and in the end no shots were fired. U.S. military warships believe the Revolutionary Guard boats were "testing our defenses," the officials said.

CHENGDU, China - A powerful earthquake toppled buildings, schools and chemical plants Monday in central China, killing more than 8,700 people and trapping untold numbers in mounds of concrete, steel and earth in the country's worst quake in three decades.
The 7.9-magnitude quake devastated a region of small cities and towns set amid steep hills north of Sichuan's provincial capital of Chengdu. Striking in midafternoon, it emptied office buildings across the country in Beijing and could be felt as far away as Vietnam.
Snippets from state media and photos posted on the Internet underscored the immense scale of the devastation. In the town of Juyuan, south of the epicenter, a three-story high school collapsed, burying as many as 900 students and killing at least 50, the official Xinhua news agency said. Photos showed people using cranes, mechanical hoists and their hands to remove slabs of concrete and steel.
Buried teenagers struggling to break free from the rubble, "while others were crying out for help," Xinhua said. Families waited in the rain near the wreckage as rescuers wrote the names of the dead on a blackboard, Xinhua said.
The earthquake hit one of the last homes of the giant panda at the Wolong Nature Reserve and panda breeding center, in Wenchuan county, which remained out of contact, Xinhua said.
In Chengdu, it crashed telephone networks and hours later left parts of the city of 10 million in darkness.
"We can't get to sleep. We're afraid of the earthquake. We're afraid of all the shaking," said 52-year-old factory worker Huang Ju, who took her ailing, elderly mother out of the Jinjiang District People's Hospital. Outside, Huang sat in a wheelchair wrapped in blankets while her mother, who was ill, slept in a hospital bed next to her.
Xinhua reported 8,533 people died in Sichuan alone and 216 others in three other provinces and the mega-city of Chongqing.
Worst affected were four counties including the quake's epicenter in Wenchuan, 60 miles northwest of Chengdu. Landslides left roads impassable Tuesday, causing the government to order soldiers into the area on foot, state television said, and heavy rain prevented four military helicopters from landing.
Wenchuan's Communist Party secretary appealed for air drops of tents, food and medicine. "We also need medical workers to save the injured people here," Xinhua quoted Wang Bin as telling other officials who reached him by phone.
To the east, in Beichuan county, 80 percent of the buildings fell, and 10,000 people were injured, aside from 3,000 to 5,000 dead, Xinhua said. State media said two chemical plants in an industrial zone of the city of Shifang collapsed, burying hundreds of people and spilling more than 80 tons of toxic liquid ammonia.
