DarkD3's website was taken down for some reason and D3 players have been searching for the mod files ever since. Luckily I downloaded all the files before the website was removed.
For those who don't know what DarkD3 is, it is a graphics mod for Diablo 3 which greatly improves the visuals of the game.
You will NOT get banned for using this mod because of the following:
1. It is purely cosmetic and has no affect on gameplay.
2. It has been somewhat approved by Jay Wilson (orignal game director).
3. Thousands of players use DarkD3 since launch and zero players were banned.
The mod's effects ranges from numbers 1 - 7. The higher the number, then the more dark and
grim your game will look.

Instructions:
1. If this is the FIRST time you start Diablo III or the first time after a recent PATCH,
launch the game then close it, before you proceed.
2. Open the folder which contains the ZIP file of your desired effect.
3. Extract the ZIP file in the same folder and 5 files should appear.
4. Copy the 5 files to your game directory (eg. C:\Program Files (x86)\Diablo III).
5. Run Diablo III. If the game crashes:
Try starting the game again if this happens.
OR run the game without the launcher by running "Diablo III.exe" and not from your desktop
OR using the "Diablo III Launcher.exe"
6. Use the Pause key (beside the Scroll Lock key) to turn the effects On/Off.

How to uninstall:
- Remove the following from your Diablo III install folder:
darkD3_Shaders
d3d9.dll
darkD3.fx
darkD3_Readme.txt
darkD3_Settings.h
First off, this does go against the terms of use and you can be permanently banned for using it. Secondly, just because many people haven't been banned doesn't make using the mod alright.
There has already been a blue post on this exact same topic.
It does not give the player any advantage in any way and therefore is not a cheat.
The blue post you linked is quite outdated (December of 2012). Nowadays DarkD3 has widely been accepted.
There is no harm in using the mod, it's even untraceable since it does not change the game files at all, instead it uses SweetFX to enhance visuals. The fact that thousands of players have been using DarkD3 since launch (and even since the beta) and not a single one of them got banned up to this date proves that it's safe to use.
Just pointing out, the twitter post you linked is almost three years old.
To be fair, both the forum post saying "All mods are in violation of the Diablo III Terms of Use and can result in your account being permanently banned" and the tweet saying "I agree DarkD3 is not a cheat...yet. As long as it is not a cheat, no ban is likely" are from May 2012.

I've been using DarkD3 since day 1 of release (well almost, or as soon as it came out). Never been banned for it. Still going strong.
