hey i have been reading this forum long ago ,and finally decided to post on it . so my question is what would happen if the korea situation is resolved tomorrow.
maybe announce the date ? or they will wait to announce so the fans dont think it was because the korea situation. and in the case of an annoucement what is the estimated date to release diablo 3 for example 15 days?
i cant wait no more to get diablo 3

Depends. Most Koreans think that the game will not pass and will be rejected, meaning there are 2 things that could happen.
a) Blizzard resubmits the game without RMAH or with some change
b ) Blizzard releases worldwide except for Korea
The thing is, if Blizzard is waiting for Korea this long, they probably will not stop trying to get game rated in Korea for quite some time. We will see.
As for announcement-> release period, most likely between 1,5 - 2,5 months.
blizz just need to let out of korea from the global release or the RMAH just from korea, because delating the RMAH would be a shit i think many people would be disappointed

As you know well, there would be no other issues that keep Blizz from telling the date. It is only my guess thought.
They'll most likely announce it between mid Jan and mid Feb. I only say mid Feb cause Blizz will probably leave a "forget the Korea RMAH and ratings situation never happened" gap between tomorrow and the announcement so it don't look like it was Korea's fault.
Blizz can only give us a release date once the Korea situation is resolved, which is tomorrow, then only can they be 100% sure about a release date.
I don't think Blizz will "delay" the game/release date again if Korea denies the version Blizz gave them (the one with RMAH but without the cash-out option), since Blizz took out the "illegal gambling" prospect/idea out of the game, even though the initial D3 version they gave them were 100% legal. Therefore the chances of Korea approving is much higher.
The only problem is if Korea denies the given build...this either mean:
1 - Blizz will continue to submit material to them, hoping they'll approve (Not likely), then only if they approve, they'll release the game.
2 - Blizz will not have a global release, since Korean can just buy the game in another country and bring it to Korea and play, since it's not region locked. (Is this correct? I'm not 100% sure... )
BUT even if Korea approve, it will be interesting to see how Blizz will handle it. With Korea's approval, Koreans is suppose to only play the game without the cash-out option (since that is what Blizz submitted)...so will Blizz restrict Korea as a region so that you won't be able to cash-out even if you (as a Korean) buy the game outside of Korea and brings it into Korea? Meaning if you buy the game in say Japan/China and are able to play there WITH the cash-out option, but the second you bring it into Korea the cash-out option gets locked?

All previous Blizzard games, including expansions, had their release dates announced during press releases. The most recent, Starcraft 2, had its release date announced 3 days before the corresponding conference call.
For months different blizzard reps were saying the game was ready and they mostly needed to test bnet servers and other minor things with the beta. It wasn't until after the korean situation that they stated they "had been given more time" to polish, fix bugs, or rework any systems like with runes. The korean rmah problem is *the* reason it's not already released.
But, hopefully when they do release it we'll have a kick ass rune system and maybe a few other things that would have been D3 Patch 1.1 instead of release. Also, I know they don't want to delay the game indefinitely because of korea. They've already delayed it a few months because of them, so I'm guessing that if the koreans still won't cooperate about the rmah they'll just release it to the rest of us anyways and give them a version with no rmah at all.

I've been following Digital Castration for a while now and I like what he/she writes because it is though-provoking and generally intelligent dialogue. However, for the most part I've found most of the posts that end up being controversial are still heavily opinionated and/or based on correlated evidence instead of hard evidence. Not that I don't recommend them for a good read, but it's a good idea to keep a critical eye when these kinds of posts are made.
On topic: Who knows why Diablo 3 has been delayed? I'd say Mike Morhaime probably wasn't lying when he wrote this back in September:

Why do people keep using official statements as a reason for why it's not the korean rmah? It's called public relations. They aren't telling the whole truth. What they are doing is technically telling you the truth, that the game needs some work, but not telling you why it's delayed. They game will always need work. There will always be bugs to fix. They will always be fine tuning things like runes. If the game not being "done" or having bugs prevented it's release it would never be released. What if the 2004 WoW team had waited until they "polished" the talent system until it's what we'll see in the MoP expansion? A 2012 WoW release.
Also, if you cite official statements as proof then you are contradicting yourself. Time and time again official blizzard representatives said the game was practically done. It wasn't until after the korean delay that they were forced to walk that back with political weasel words. So which official blizzard statements are you saying we should believe? The ones before the korean delay or after? If you believe the korean rmah isn't the reason for the delay then their corporate spin team is doing a great job against you. Maybe mitt romney should hire them for the 2012 election?

Mmm, polishing a game that was basically ready for another 6 months? For me that's a bit to long. I think most people (me included) blame the Korea situation for the delay cause, as you mentioned, Korea is the only thing in the news atm...but regardless of that, I still think it's Korea.

what about if they already have the patch to fix it but they are delaying it because some other reason, (for example korea)
