I like the warning and then the 2 hours ban. But you have to think.. what about people who are having a conversation and trip the spam filter? I've been kicked and banned countless times in IRC channels for 'spamming' when really I was just typing really fast having a heated conversation. I don't think there's any good way around it.
Maybe if they logged infractions and a warning was given after each infraction and if in a certain time frame (say 1 hour) they reached a set amount they're banned for 2 hours. Then after each additional ban (for spam) have the ban limit increase at first to 4 hours. Then 10. Then a day, etc.
But there's no stopping even that 'cause they'll just keep creating new accounts.
Blizz was able to get a handle on Spammers in WoW and I can only assume they will carry those techniques over to Battle.net 2 and D3.
Items being sold is something that there is no control over. As long as there is money to be made, gold/item farmers will be selling D3 items. It's like saying a concert should be able to control ticket scalpers. You just can't control what happens outside of your juresdiction.
