Make no mistake, a EULA is most definitely a contract. While it's origins lie in IP protection, and to indemnify the owners of the product, it can be equally used as a means to prosecute.

The thing about D2, is it was best after it was out a couple months and a few of the dupes and bugs were fixed. But the game was heavily flawed. They continuely tried to fix it, only making it worse at each time. The first year of LoD was probably the prime for most people. When they made the enigma patch, don't remember the number of that patch, they ruined the game for me. For most people though, that was the patch they liked the most. Don't know why though, it ruined the community and the exploration of the game. Every game became Baal bot tele's to Baal, sends portal, everyone goes in. Baal bot kills baal. Baal bot and a few of the other players run "pick it" program so legit players are left with isenharts case. In the end though, your build and your gear didn't matter because you didn't have to do a damn thing but stand in a corner. They finally threw their hands in the air and came up with ladder seasons because the game was so broken. Ladder season were meant for a fresh start and to get rid of all the old duped and hacked gear. What they became was a bot race to 99 and a money making endeavor for the bots/hackers because a new economy meant they would have all the best gear the quickest. Bots and hackers completely controlled the ladder economies. The duped and hacked gear would show up in ladders too. So in the end, ladders did nothing to solve the problems it was meant to solve, it actually made those problems worse. Not only that, I really don't like grinding chars up again everytime a new season started. I suppose thats why in the only 2 ladder seasons I played, I quit bnet each time after the ladder season was over. The fact that ladders had exclusive content really angered me to be honest. I took one 3year break from D2 but other than that, I have always played D2 from Day 1 when the servers lagged out the whole day up to when I got a D3 beta invite. I just learned to stay off bnet because the game was too broken to play with others. Your last statement about choices is passive aggressive and you obviously feel you are a better player than me. Nothing I will say is gonna convince you any other way, no matter how many times I show D2 was a broken game with a broken skill system. Even with its faults, D2 was a great game. But there is no way I would play that game again now nor do I want some of its worst features, like the skill tree replacing the current skill format. I wouldn't mind to see choices with trees that add to skills we already have in an end game capacity but are still easily reversable.
To me, D3 is infinitely better in its current form. D3 actually continues to improve with every update. I think the future is bright for D3. I believe the new director and the team is taking the game in a better direction than Jay Wilson did. Nothing stays the same and change happens, we have to learn to accept it. Game mechanics that worked well enough 13 years ago have been able to be studied and defeated by gamers already. We need new challenges, not the same tired old systems.

My feedback suggestions on MF, the blacksmith, and itemization. I am going to use these 3 mechanics to solve each other or solve 3 birds with one stone.
I would like to see improvement with all 3 mechanics and I think while this could take sometime to implement, I feel the final implementation would make everyone’s Diablo 3 experience better.
Suggestion A) Itemization with the blacksmith. As of right now, we are paying the blacksmith like 50k to craft and identify junk items for us when it comes down to it. What if the blacksmith could take a stat from one item and put it on another item. Item with removed stat is used up in transfer. Also, we must put new stat over an already existing stat on item we wish to keep. I thought about allowing both items to still be maintained after item swap, but lets face it, there is a huge amount of lvl 50-60 items out there that are worthless except for one or two nice stats. This could be a nice item sink. Also, items can only have a stat applied once. At that time they change colors to look kind of like the crafted items in D2. This will allow people who buy off the auction houses to make the proper decisions with items.
The rules for stat transfer with the blacksmith go like this:
1) Items have to be within 10 levels of each other.
2) Items can not break their stat budget. (if the max intel on item is 200, putting 220 stat on it would make it 200)
3) Only same type of items can be used. Swords and swords, not swords and axes or boots.
4) Legendaries need other legendaries. Rares need rares. Can’t transfer with magical blues.
5) Items are only allowed 1 transfer after which time they are changed to red-orange like D2 crafted items.
6) The transfer will cost gold, tome of secrets and crafting mats of highest item.
This could allow items missing one stat we want to become desirable. This will make items with one good stat desirable as well. We can put our class main stat or vitality over worthless stat. We can add MF/GF to items we already have that have less than desired stat. This could solve the gear swapping problem many people have.
Also how does the blacksmith suddenly gain this ability? Maybe we find a new spawn in game that drops the "Nephalem Cube." Or maybe we can call it the Nephalem Hammer. Kind of like Charsi’s imbue hammer from D2. Rare spawn should be in Act 4 Hell or inferno Act 1 my opinion. Or maybe, we have to find pieces of the hammer throughout many different acts. People want endgame content, something else for them to chase after.
Suggestion B ) ALL MF/GF lost when switching gear during fight. That is right. 0%. No bonus from from NVB either. (NVB = Nephalem Valor Buff) No loss of NVB stack, just no bonus on current monsters. If you can’t identify when a player is in combat or not, make a gear swap cooldown on MF/GF of like 3 minutes. (this one later became a suggestion from blizzard.)
Suggestion C) Class specific items will automatically role class main stat or vitality before non main stats can appear on item.

What I remember most was we as a community did not have the knowledge to know what was the best skill template, we didn't have many high levels and no bots doing boss runs. Basically, we didn't know what skills to use, didn't know which gear to get or everything that was out there, and we didn't have high levels with optimal skills and gear to drag us quickly through the lower levels and rush our experience for us. Rushing became much easier after LoD because even if you were too low in the area, the experience was good. Originally, if you were too low to be in an area, your experience gain was very very slow.
I remember, it took me about 9 months to get every piece of gear I needed for my Bowazon. That gave me 3 months of collecting SoJ's before LoD came out.
I do expect this game to be hard. I do believe we'll have a lot of dedicated gamers in Inferno within the first week. I also believe by 3 months in, some groups will be facerolling inferno. Just like D2. The average player that has a life outside gaming, like me back in 2000, will probably start to successfully farm a little sooner than 6 months though. The RMAH and the GAH will allow a slight speed up in how quick the average player gets through inferno. Once the dedicated players have inferno on farm, the inferno gear will start to spread throughout the game slowly, than abit faster, than fairly quickly.
I feel many underestimate the casual gamer. They can be highly skilled, but don't want to waste lots of time playing a game. For that reason alone, I do think many players can and will complete inferno as long as they can have access to the proper gear. D3 will be hard, but not Atari hard.
