This is an open letter to blizzard about the botting/cheating that has gone rampant on Diablo 3 since the beginning of its release. I will NOT be providing any links to any of these bots/cheats or any names of them so don't PM me or ask in this forum post please. This letter is for Blizzard to read and understand that if they don't start actively banning these botters/cheaters like they actively do on their other games, I will file a class action lawsuit against them for not upholding their TOS/EULA which clearly states the use of any (and I repeat ANY) 3rd party software is prohibited.
Since Blizzard (Nevalists) has stated on their forums quote:

Many of the changes we have coming in 2.4.1 came from feedback not only from the previous PTR, but that we collected throughout and after the release of patch 2.4.0. While we don't always reply to such feedback, it is being read and passed along on a regular basis."
I have come here to get their attention since they read these forums more than their own forums as nothing but trolls are on theirs. This is a very important matter that they seem to think is not an issue. Currently there are 3 major bots that are ruining the Diablo 3 game due to lack of Blizzard bans. Let me show you what a real company does to actively show they are against the bots:

What is an Illegal Program (or Bot program)? Any software or application that runs concurrently, takes over, or replaces the Silkroad Online game client with the main purpose of partly or wholly playing as the human user in the game.
So my question to Blizzard is, if a small indie company like Joymax that actively bans botters and posts them on a wall of shame monthly how come you cant? How come people have to beg for a response from your team that should be actively fighting against things like these botters?
I can easily find all these bots/cheats with a single google search, why can blizzard not do this and spend a little time and money to see how they can catch the users of these programs? I know they have warden but let me give you some examples of how EASY it would be to catch these botters/cheaters.
Example 1: One particular bot runs the exact same path in town regardless of what script they are running. Lets say they are running rifts, it will either kill rift guardian or not kill rift guardian and go to town. If the character is full of gear this is the exact pathing the bot will run:
*Waypoint to ID all tomb *ID all tomb to waypoint *Waypoint to Stash (put all gear that user has set to keep in stash leaves rest in inventory) *Stash to Waypoint *Waypoint to Blacksmith (destroys all yellows, blue, and white items with the salvage all keys and any legendaries that were not stashed get salvaged.) *Blacksmith to Waypoint *Waypoint to NPC (depending on the act they are in depends on the NPC used, all of the NPCS used are close to Waypoint so another easy catch) *NPC to Waypoint *Waypoint to Obelisk *Rinse and repeat
Example 2: People using a know HUD cheat never go down dead ends due to the massive map hack advantage they have. They also bypass elites that would normally kill them with the affix's they have but since they can see this from 3screens away there is no danger they just bypass them one way or another. I don't know if Blizzard actually plays the game but have you tried to stay alive on grift 70+ while putting mouse over a moving mob to read the affix's they have on health bar? Lets just say nobody does because there isn't enough time and you will probably die. So this is easily caught by reading logs you can find majority of these cheaters by looking at their leg drop to pick up and id ratio. Majority of these users don't pick up legendary's that will just be trashed so they can go longer in rifts/grifts and not have to spend long in town (aka they don't identify legendary's they know will be instant salvage just doesn't happen). This program also tells you if the item is ancient or not before it is even identified so that is another way to catch these cheaters. I know so many people that use this cheat and all of them wouldn't play the game without it as they have told me numerous times.
Example 3: A different bot uses injection code, this should be a no brainer for you Blizzard. Does someone need to school you on how to find if someone is injecting code into your client?
That's just 3 of MANY ways they can catch these botters/cheaters, yet how many people have we seen banned from this game since the release? I remember 1 ban wave back about 2 years ago due to AH exploits but had nothing to do with the bots. I know some people got bans for other things like running Diablo 3 on Linux (which is my assumption they do this because they cant monitor Linux systems like they can windows or mac's with Warden or its possible linux sends false positives flagging user account which is on their end and should be able to be fixed with some time and money).
So Blizzard, are you up to the challenge of cleaning up your game or do I need to file a class action lawsuit to get the money back from you for all users that bought Diablo 3 and ROS in which you have blatantly lied to about numerous things? Can anyone say PVP (I know I will get flames for this part and just so you know brawling isn't PVP its brawling complete difference). We upheld our end of the deal Blizzard (the ones of us that are legit) by following your TOS/EULA to the T when we purchased the game and acknowledge them. Yet the users that bot/cheat don't follow the TOS/EULA and get away with it because you are not fighting against them. Just because this is not a subscription based game doesn't give you the right to turn a blind eye to the rampant botting/cheating happening in your game. Just because this is not WoW doesn't give you no right to ignore the issues at hand. I can name another game that you actively ban people on that isnt subscription based, Overwatch, so what is the difference between Diablo 3 and Overwatch? PVP!!!!!! and if there was PVP in Diablo 3 I can guarantee that these botters/cheaters would be dealt with unlike the last few years. Just because this game is PVE only doesn't mean that the botters/cheaters are not affecting everyone else as they are. Just like the recent PTR nerfs to wizard are because 1 guy that is paragon 2500+ who is a botter/cheater causing your numbers to be inflated as to what legit players actually achieve during each season.
TLDR: Class action lawsuit against Blizzard if they don't start upholding their own TOS/EULA for all Diablo 3 players, and don't say it is not possible as they do it with all their other games even the crap card game Hearthstone. So why should Diablo 3 be different, why are you trying to ruin the best series you have ever created by allowing botters/cheaters to run rampant Blizzard?

Multi-boxing also uses 3rd party tools to control all characters with 1 action meaning you should also be banned for cheating.

Everything I have stated is FACT, you however posted about a quote: "Steelseries headset" that relates to your small mind that cant comprehend someone filing a class action lawsuit against a company that has went above and beyond lying to their customers. This is why we have LAWS against FALSE ADVERTISMENT. Please go take some class's to educate yourself on why we have LAWS to combat against companies that think they can sell you something on dreams and wishes. I haven't actually bothered to read the ToS, mainly because it's long and boring, and I have bad eyesight. That aside, I find it doubtful that Blizzard would have included a statement which equates to "We will ensure that our game remains bot/hack/cheat-free, and accept liability if it is not.". Generally speaking, the ToS and EULA are used to define the requirements and rights of the end user, not the developer, publisher, etc.
Without a clearly stated guarantee of a 'clean and fair' gaming environment, within a legally binding document, Blizzard could not be held accountable. This threat of a class action lawsuit just sounds like wishful thinking to me.
Personally, I play solo for like 90% of the time (I play monk, and nothing else), have never botted or used 3rd party apps, etc. When I do venture out into public games for split bounties, I never see any unusual behaviour, and there definitely isn't anything that makes me feel like my gaming experience has been ruined. Given the amount of time I spend in-game (casual these days), I don't focus on hitting leaderboards, I just play to optimize my build on my own terms and see how high I can get with it - you know, playing for fun.
Im just gonna throw this out there, and I'll probably get flamed for it, but that's fine with me. THUD has the capability to actually improve the competitive elements of the game for leaderboard leaders. THUD doesn't actually modify the game-world around you, it just makes you more aware of your surroundings (mob density, clear path to exit, etc. - these were the core features the last time I looked into it). Which allows the player to make informed decisions in real-time. 2 players competing for a top spot, and both using THUD (or some similar program) would then be challenging each other in terms of how well they can assess the current read-outs and act on them. In other words, THUD adds the element of competitive decision making,
As for bots, they basically just give extra xp while offline, as many other online rpgs do (generally mmorpg rather than arpg). The 1 exception to this bonus is key/mat stacks, although for competitive players, mats aren't an issue as gears are already perfect rolled. Bots would still have advantage in the number of keys, but tools such as THUD could reduce the need for fishing, which lessens the impact of those keys.
So in short, I'm for tools like THUD which maintain player control and encourage competitive play. At the same time, I do not take interest in botting, but provided we don't see GR bot parties at any point in the future, I can't actually see them as being harmful to the community.

So with AH we had duped items, since start of game we have had spam bots that "online only didn't fix", MF bots, and regular bots. So please tell me again they didn't say ""We will ensure that our game remains bot/hack/cheat-free, and accept liability if it is not." when their entire reasoning behind online only was to prevent all the things we are bringing up today hence your maphack you love using which I wont name as you have named for others to cheat. Your precious HUD needs to have all its users banned you are cheating period. Almost forgot Edit # 2 here is part 1(C)II so you can understand fully:

Well, I have no problem doing that on GR80 and so as many other legit players. I have seen people using Turbo HUD and only find that its interface only annoys you more than helping.
I know botting is not a right thing to do, illegal to the game maybe but I don't see there is anything botting can annoy you this much :))

Apparently you are still missing the point. Blizzard's EULA/ToS DO NOT state a guarantee for end-user gameplay expectations. What they DO state, is that if the END-USER acts outside of the agreed boundaries, the END-USER will be held accountable, and MAY be punished in accordance with the legal agreement.

This is all assumptions on your part. I have valid proof they do nothing to botters and cheaters that I dont need to prove to you. This is a request for Blizzard to do something before they get their butt handed to them in court for allowing these attrocaties to the Diablo series. Why dont you go check out the WoW forums and see how actively they ban botters this game is no different o wait yeah no sub so Blizzard doesnt want to dip into their 30billion+ off of sales for Diablo 3. I get it be as cheap as possible to have the highest profit margin, thats cool and if thats how Blizzard wants to play it I will just take them to court.

On the topic of handling botting/hacking/etc. your latest post still does not clearly link the contents of the EULA/ToS to the legal article you believe was breached. The statement remains the same; you misinterpreted the agreement, and now expect compensation from Blizzard.
As for your argument against missing features, this would be treated as a separate breach. You could possibly have more of a case there, depending on where and how the guarantee of PvP features were published, and to what extent the content was guaranteed. If a legallly binding contract states that players would be able to interact with each other in a pvp environment... they have done that with brawling. Although it would not be what any of us anticipated.

This is an open letter to blizzard about the botting/cheating that has gone rampant on Diablo 3 since the beginning of its release. I will NOT be providing any links to any of these bots/cheats or any names of them so don't PM me or ask in this forum post please. This letter is for Blizzard to read and understand that if they don't start actively banning these botters/cheaters like they actively do on their other games, I will file a class action lawsuit against them for not upholding their TOS/EULA which clearly states the use of any (and I repeat ANY) 3rd party software is prohibited.
Since Blizzard (Nevalists) has stated on their forums quote:
"We're always reading the forums (as well as other fan sites, like Reddit or Diablofans, for example) for suggestions and feedback, regardless of where we're at in development. Just bear in mind that during a PTR, we usually have a particular focus!
Many of the changes we have coming in 2.4.1 came from feedback not only from the previous PTR, but that we collected throughout and after the release of patch 2.4.0. While we don't always reply to such feedback, it is being read and passed along on a regular basis."
I have come here to get their attention since they read these forums more than their own forums as nothing but trolls are on theirs. This is a very important matter that they seem to think is not an issue. Currently there are 3 major bots that are ruining the Diablo 3 game due to lack of Blizzard bans. Let me show you what a real company does to actively show they are against the bots:

What is an Illegal Program (or Bot program)? Any software or application that runs concurrently, takes over, or replaces the Silkroad Online game client with the main purpose of partly or wholly playing as the human user in the game.
So my question to Blizzard is, if a small indie company like Joymax that actively bans botters and posts them on a wall of shame monthly how come you cant? How come people have to beg for a response from your team that should be actively fighting against things like these botters?
I can easily find all these bots/cheats with a single google search, why can blizzard not do this and spend a little time and money to see how they can catch the users of these programs? I know they have warden but let me give you some examples of how EASY it would be to catch these botters/cheaters.
Example 1: One particular bot runs the exact same path in town regardless of what script they are running. Lets say they are running rifts, it will either kill rift guardian or not kill rift guardian and go to town. If the character is full of gear this is the exact pathing the bot will run:
*Waypoint to ID all tomb *ID all tomb to waypoint *Waypoint to Stash (put all gear that user has set to keep in stash leaves rest in inventory) *Stash to Waypoint *Waypoint to Blacksmith (destroys all yellows, blue, and white items with the salvage all keys and any legendaries that were not stashed get salvaged.) *Blacksmith to Waypoint *Waypoint to NPC (depending on the act they are in depends on the NPC used, all of the NPCS used are close to Waypoint so another easy catch) *NPC to Waypoint *Waypoint to Obelisk *Rinse and repeat
Example 2: People using a know HUD cheat never go down dead ends due to the massive map hack advantage they have. They also bypass elites that would normally kill them with the affix's they have but since they can see this from 3screens away there is no danger they just bypass them one way or another. I don't know if Blizzard actually plays the game but have you tried to stay alive on grift 70+ while putting mouse over a moving mob to read the affix's they have on health bar? Lets just say nobody does because there isn't enough time and you will probably die. So this is easily caught by reading logs you can find majority of these cheaters by looking at their leg drop to pick up and id ratio. Majority of these users don't pick up legendary's that will just be trashed so they can go longer in rifts/grifts and not have to spend long in town (aka they don't identify legendary's they know will be instant salvage just doesn't happen). This program also tells you if the item is ancient or not before it is even identified so that is another way to catch these cheaters. I know so many people that use this cheat and all of them wouldn't play the game without it as they have told me numerous times.
Example 3: A different bot uses injection code, this should be a no brainer for you Blizzard. Does someone need to school you on how to find if someone is injecting code into your client?
That's just 3 of MANY ways they can catch these botters/cheaters, yet how many people have we seen banned from this game since the release? I remember 1 ban wave back about 2 years ago due to AH exploits but had nothing to do with the bots. I know some people got bans for other things like running Diablo 3 on Linux (which is my assumption they do this because they cant monitor Linux systems like they can windows or mac's with Warden or its possible linux sends false positives flagging user account which is on their end and should be able to be fixed with some time and money).
So Blizzard, are you up to the challenge of cleaning up your game or do I need to file a class action lawsuit to get the money back from you for all users that bought Diablo 3 and ROS in which you have blatantly lied to about numerous things? Can anyone say PVP (I know I will get flames for this part and just so you know brawling isn't PVP its brawling complete difference). We upheld our end of the deal Blizzard (the ones of us that are legit) by following your TOS/EULA to the T when we purchased the game and acknowledge them. Yet the users that bot/cheat don't follow the TOS/EULA and get away with it because you are not fighting against them. Just because this is not a subscription based game doesn't give you the right to turn a blind eye to the rampant botting/cheating happening in your game. Just because this is not WoW doesn't give you no right to ignore the issues at hand. I can name another game that you actively ban people on that isnt subscription based, Overwatch, so what is the difference between Diablo 3 and Overwatch? PVP!!!!!! and if there was PVP in Diablo 3 I can guarantee that these botters/cheaters would be dealt with unlike the last few years. Just because this game is PVE only doesn't mean that the botters/cheaters are not affecting everyone else as they are. Just like the recent PTR nerfs to wizard are because 1 guy that is paragon 2500+ who is a botter/cheater causing your numbers to be inflated as to what legit players actually achieve during each season.
TLDR: Class action lawsuit against Blizzard if they don't start upholding their own TOS/EULA for all Diablo 3 players, and don't say it is not possible as they do it with all their other games even the crap card game Hearthstone. So why should Diablo 3 be different, why are you trying to ruin the best series you have ever created by allowing botters/cheaters to run rampant Blizzard?

Don't like the game, don't play. Don't like how it's going, no one said you had to play seasonal so stay out of the competition. It's not like there is a cash prize at the end of each season or like you are paying a monthly subscription and feel entitled to get what you want...
I play with friends, we focus on our game play. We don't worry about everyone else. Botters, Streamers - no difference.
You can claim all day with your botting/cheating friends as I guarantee you use both and is why you are so incentivized to post on these asap about how it doesn't affect you.
It's understandable, you feel entitled to get more than you are now - so you have to go "Anon" and post about it in a public place. I noticed your post when I came to update my demon hunter build. You know, because it's Friday night and I have nothing better to do.

I haven't actually bothered to read the ToS, mainly because it's long and boring, and I have bad eyesight. That aside, I find it doubtful that Blizzard would have included a statement which equates to "We will ensure that our game remains bot/hack/cheat-free, and accept liability if it is not.". Generally speaking, the ToS and EULA are used to define the requirements and rights of the end user, not the developer, publisher, etc.
Without a clearly stated guarantee of a 'clean and fair' gaming environment, within a legally binding document, Blizzard could not be held accountable. This threat of a class action lawsuit just sounds like wishful thinking to me.
Personally, I play solo for like 90% of the time (I play monk, and nothing else), have never botted or used 3rd party apps, etc. When I do venture out into public games for split bounties, I never see any unusual behaviour, and there definitely isn't anything that makes me feel like my gaming experience has been ruined. Given the amount of time I spend in-game (casual these days), I don't focus on hitting leaderboards, I just play to optimize my build on my own terms and see how high I can get with it - you know, playing for fun.
Im just gonna throw this out there, and I'll probably get flamed for it, but that's fine with me. THUD has the capability to actually improve the competitive elements of the game for leaderboard leaders. THUD doesn't actually modify the game-world around you, it just makes you more aware of your surroundings (mob density, clear path to exit, etc. - these were the core features the last time I looked into it). Which allows the player to make informed decisions in real-time. 2 players competing for a top spot, and both using THUD (or some similar program) would then be challenging each other in terms of how well they can assess the current read-outs and act on them. In other words, THUD adds the element of competitive decision making,
As for bots, they basically just give extra xp while offline, as many other online rpgs do (generally mmorpg rather than arpg). The 1 exception to this bonus is key/mat stacks, although for competitive players, mats aren't an issue as gears are already perfect rolled. Bots would still have advantage in the number of keys, but tools such as THUD could reduce the need for fishing, which lessens the impact of those keys.
So in short, I'm for tools like THUD which maintain player control and encourage competitive play. At the same time, I do not take interest in botting, but provided we don't see GR bot parties at any point in the future, I can't actually see them as being harmful to the community.

So with AH we had duped items, since start of game we have had spam bots that "online only didn't fix", MF bots, and regular bots. So please tell me again they didn't say ""We will ensure that our game remains bot/hack/cheat-free, and accept liability if it is not." when their entire reasoning behind online only was to prevent all the things we are bringing up today hence your maphack you love using which I wont name as you have named for others to cheat. Well, I have no problem doing that on GR80 and so as many other legit players. I have seen people using Turbo HUD and only find that its interface only annoys you more than helping.
I know botting is not a right thing to do, illegal to the game maybe but I don't see there is anything botting can annoy you this much :))

If you went into a court room with nothing more than what you have stated in this thread so far, you would be thrown out of court (in fact, you likely would never get into the court to begin with).
Apparently you are still missing the point. Blizzard's EULA/ToS DO NOT state a guarantee for end-user gameplay expectations. What they DO state, is that if the END-USER acts outside of the agreed boundaries, the END-USER will be held accountable, and MAY be punished in accordance with the legal agreement.

This is a request for Blizzard to do something before they get their butt handed to them in court for allowing these attrocaties to the Diablo series.
