    Either way, no NDA exist, Though you could easily call it an "effective NDA" if you will, though that terminology is incorrect, because basically the press and fansites are not allowed into the beta until the closed beta starts, but as we've seen, some people have gotten past it. Most notably Day9 and now most recently Athene and Yogscast.

    Their access will be revoked if they are considered press by Blizzard, it's not that these guys are allowed to play the game but can't post about it, they're absolutely not allowed to have access to it at all, and that access will be revoked as soon as possible.

    Their access was revoked again, there is no NDA. (By revoked i mean those prior to having been invited today, those from today/yesterday has yet to get their access revoked)

    While the game itself is content done, and could therefor, theoretically go gold already now, the beta is still a prerequisite of figuring out the release date as they still need the beta to finetune the server infrastructure, otherwise they're basically banking on the fact that they have no idea how the client will work in a live enviroment and that they can fix all of this before the release.

    I would expect that they have the information they need shortly after the beta, but definitely not before.

    It'll likely take more than a year, you can't compare the Starcraft 2 beta as local play just required an AI. The hackers have yet to actually emulate battle.net for Starcraft 2, though they have made some basic progress at the moment to the point that they can basically bypass it and play against eachother.

    This will still be less than what is required for Diablo 3 though, they need proper battle.net emulation, they can't just "bypass" it, and i figure that will atleast take a year, unless there are some very determined individuals who don't get caught or stopped first.

    Would assume this to be the case as well, likely they, behind the scenes, maintain servers when not a full capacity.

    The problem with your question is that we don't know how much of the game we'll be getting. It is server based. I expect it to be between 5 and 10 gigs, but wouldn't be surprised if it was less then 5. It will be less than 10, no doubt.

    The serverside stuff such as AI, drops, etc. won't be very big so it won't influence the size much.

    The beta itself is only around ~2.25GB in size, but there will to some extent be reusing of various assets throughout the game, i'd figure it would be larger than 5GB but smaller than 10GB.

    You are missing the point. Unless the agreement contains a fixed penalty paragraph (which I highly doubt when it comes to a beta NDA) Blizzard has the option to sue him/her for damages. These damages need to be substantiated. Which damages has Blizzard suffered in this (that you can quantify)?

    Personally i find the poor quality of the photos to be damaging, quantifying it into a cost, however, is a whole different ballgame.

    Not sure, was pretty stupid of him to post it to begin with, don't know if he was also stupid enough to think he would still have a future inside the gaming industry after today, could also be Blizzard telling him to delete everything before they call out the lawyers.

    Probably to prevent you from leaving to avoid dieing like a lot of people did in Diablo 2.

    This, likely it's exactly like WoW, 20 seconds out in the field, instantly inside towns/inns.

    You can of course just alt+f4 but it'll just take the game longer to remove you from the game world, potentially killing you(Which is likely why it's not even an option)

    Well...

    I see life potions on his bar...

    There are definitely potions in the game, they've just changed it from being a potionfest to be something that can help you out of a tough spot once in a while due to the cooldown.
