I agree that the BoE can be an issue. Let us see what Blizzard comes up with. They may have learned a few tricks from WoW.
We also need to see how much better the BoE is than the none High Level BoE equipment. If it is just marginal increase than it may not be that much of an issue. I hope the properties of the BoE are not overpowered to the none High Level BoE. Then we will likely have the same issue as in LoD with many players running around with the same gear on the slots. The only thing is that those items can not be transferred down to the next character. It becomes almost a none issue if playing softcore since respecs are likely in the game so you only need 5 character at least until the expansion arrives. HC is another matter since when a character dies you would have to start a new one. I hope they do not implement a microtransaction to revive a RIP HC character.

I think Blizzard will come up with something that will balance out the BoE and for the PvP.
It was suggested to have PvP wagers or maybe drops for defeating other players. Arena's that hand out prises based on how well you did. Side benefit would be achievement points.
Maybe Achievement points can be used to buy extra MF potions that will increase MF for a period of time
Improve Gambling if it is still in the game.
Offcourse the important part is the drop rate.

It does hinder PvP cause now I can't really try gear on if it is BoE, I can trade for it, and find out it sucks then bam I just got ripped off cause this item sucks, were as now I can trade, equip...try it...don't like it...meh trade it away, now I am forced to sell it for probably 1/3 of its value in gold and be screwed. This also helps cookie cutter builds happen cause noone will experiment nearly as much with gear if it is BoE and would likely look online for the "best" build and go with that.
I think you maybe right with more people going with Cookie Cutter builds since people are less likely to experiment with the BoE equipment. Some of the BoE is likely going to be easy to determine if it is good to use since we can use our judgment. The problem is if the BoE has a special property or oskill or something than it becomes harder to tell if it is right for your character.

I think I said it before. I do not care for either way if it is BoE or not. I do think making a quest to unbound an item to be not in the cards for Blizzard to do since that will defeat the purpose of the BoE. They maybe able to add a special binding in process that the item is not bound right away. There would have to some sort of restrictions in order for it not to be abused. I think maybe a few minutes and only in town.
We do not know how the items are going to be like and how the drop rate is going to be for the items yet. I think many of the items are going to be worked towards the end when they start to balance everything together.
They may decide that some of the quests may reward some high end items just like D1 had. If they decide to are likely going to be random side quests and they should be difficult to complete.

There will likely be mods for D3. Blizzard said the same thing about d2 about no mods. Blizzard will not support mods and that is fine with the mod making community.

As far as I know D1 was designed for single player. The multi player aspect was added late in the development cycle.
D2 was more designed to be played against monsters with PvP as a secondary concern. If it was designed for PvP first then why bother adding the monsters and the acts.
Many people who play D2 play single player and offline. Some have gone to mods to play.

We also do not know how the items are going to be like. The may decide not to have variables or not as large of a variable. There might be more items that are considered best gear and not a single piece of item.
I do not play PvP since I find that mode of play boring.

Some like to use cheats and hacks and than talk big.
Then there are the ones who duel with honor and respect. I believe these players do not like the cheats just as much as the PvMers.
