From the images I've seen each character has a cap on how much they can place in a stat. For base stats it seems to be 50 points. They each add 5 stat points each which means all stats can get a 250 bonus to their stats

Correct and from there it is a matter of time before they are able to resurrect themselves. Plus the Soulstone just fastened them to a plane such as ours, and if corrupted served to only make them more powerful.

Blizzard doesn't design games to sell only to the 5% of people with system powerful enough to run them, leaving others to turn all the settings to low only to lose the experience that the full settins would give. Also Crysis was a critical failure in sales, because of its high system requirements. It is a good game, sure, but nothing special, and realism is easy and very cheesy to do. It takes more work to create a look and feel that is unique and fantastic.

Woah woah there, they could have really done some crazy stuff like Hellgate or Guildwars with this game. Those games are nice but not Diablo, they have improved the mechanic that is Diablo and kept the general asthetics similar but that is from my point of view. I'm not saying people aren't entitled to their opinion but many have not taken into account how a game with graphics similar to Poser would look in our enviroment. To be honest one of my biggest complaint of games outside of WoW is how they aim so hard for realism that they lose a lot of emotional effect; the sensation for the most part of the games is lost since the character's arms are just plain.
What is it that exaggeration defeats from using predefined body subtypes of the previous iterations.

Ok first off would someone please define what makes something that is "cartoonish" bad. By defining something as "cartoon like" your simply stating that within the realm of Heavy Metal and Powerpuff Girls this game has similarities. Be more accurate please.
Ok here are my pros and cons about the games aesthetics at this point in the development process.
Pros-
-The characters have more depth to their physical features
-The world retains it's detailed features while still being scalable
-To some it can still resemble Diablo, its 3/4 perspective
-Outdoors look like outdoors
Cons-
-The tones of color don't use the full color wheel
-Dungeons aren't that bright
-More textural layers should be considered i.e. when it rains your character should be glistening showing that he is soaked.
Issues people bring up as cartoony right now, while somewhat concerned aren't totally valid, remember that when DiabloII was released it was made to scale from 8bit color wheel to 16bit color wheel. Now we are at 32bit (anything more our eyes can't discern) so a lot more possibilities are available to the developers. Blizzard is trying to constructively look at the gaming enviroment around them and not make Diablo II.5 this is Diablo III. Yes to say that some reworking is necessary could be nice but other then changing the color pallette do you have any other problems.
Also zooming in on a small peace of architecture is not going to prove that the artstyle is horrid, the game is designed to be viewed from afar, not with a magnifine lens. Yes when you look at it closely it doesn't look super realistic and overly detailed, Blizzard likes to make their games scalable. To do this they use simple geometric shapes that can get the point across, that set of grey blocks are a golem, so becareful about being too scrutinizing.
Answer me this, when your slaughtering 20 Skeleton warriors will you be concerned about how that one little golem will look fully magnified?
