That has been on the Diablo II Guide site since the beginning of 1.10. They do spawn, but do heavy damage and you cannot attack them. Blizzard is planning to release it in a later patch where it will be active for you to slaughter it.
35,000 accounts is only a portion of what they banned. About 3,000 - 5,000 accounts are created A DAY and about 500 - 2,000 banned A DAY. When they do mass bans like 35,000, they only tell you 1/4 to 1/8 of how many accounts were actually banned.
Blizzard would most likely make you agree to a contract of complete privacy, like they did with WoW during the first betas. I would know because I was in it. So I wouldn't try that unless you were willing to lose money over a lawsuit.
I hated that contract, I wanted to talk about WoW so bad during that time.

It would be funny if they cancelled the project. Or maybe it would devastate thousands of fat 13 year olds and lead to a mass suicide. I dunno...anyone that serious about the Diablo series? Oh well, hopefully it will come out. I am hoping for it, might be fun...for a few months...or days...like RF Online...such a disapointment...
I am in a band, we play traditional progressive death metal (if you don't know what this is...don't ask it takes a long time to explian). I am the bands lead guitarist, but I also sub for bass. I sing clean and I grunt for vocaling in the songs. Sort of an Opeth feel. We have a couple of covers we do including Opeth's Demon of the Fall and Dimmu Borgir's Allhegens Dod I Helveds Rike (grunting and singing in Norwegian is difficult). We also have about 4 original songs.
Diablo team has 8 people left (originally about 25 - 35). The other part of the team went to work for Flagship Studios, making Hellgate: London. They have hired new people, so everything will be different from the original team setup, very similar though. There are now about 20 people in the newer Diablo team.
1.12 patch won't be for a while folks, unless they get there butts in gear and make in by next ladder season start. As they are going to add all the things they were supposed to in 1.11. In 1.11 Blizzard was supposed to add 2 new acts, 2 new sets, and the rest of the uniques items. Also, Blizzard has about 25 rune words left that have not been discovered from the ORIGINAL LOD patch (1.04 beta, 1.05 for you non-familiars). So, that leaves a lot of excuses for Blizz not to add things.
I don't think it would be worth it to pay for a series that has always been free. All my friends that beta tested WoW with me quit when it turned out to be P2P. The admins on the Closed Beta told us it would be a free game except for the purchase in the store. So, anyways, I would not play it if I had to pay it.
