Have you tried PVP in normal game ? Are you aware that the damage you do to normal enemies is the amount of toughness you would nee to have in order not go get one shoted or to proc cheat death passive ? Doing billions of dmg are norm nowdays and who has that kind of toughness. So having ranged attacks , evasion and cheat death would be the factor to determine the victor. Not the gear. I can one shot you with 5 hours playtime gear.
You dont want to play the game where you lose your whole character and all the items on it just by getting him by some random primary attack ... Nobody in their right mind would do this in their best gear. So people would have some PVP gear which would be crap.
If in PVP maps dmg was scaled to our toughness and properly balanced then I would agree with you. Proper balancing for PVP in D3 is light years away

Imagine how many times you would die bcs of some cheese tactic your enemy deploys.. I guess that on average player would die more then 50 times just to starting mistakes. Imagine how many times player would die to bad balancing and OP enemy skills. This implementation in this state of the game would make PVP in HC a total disaster. Players would one shot each other and having more cheat death passives and skills would determine the victor.
No you dont . Who would play PVP if that was the case.... There was a case of dying when Brawling was introduced but only if you went to town while DoT was on you... For example barbarian Rends you and you go into town rend would still last in town and if you die in town you die for good. Then they changed so that leaving PVP map cancels any DoT on you ... IF that was not the case you could wear Fire immunity neck and have Firebird wizard burn you forever which would basically heal you so much all the time that you couldnt die
