time is not important in these cases for blizz as they can force the original owner to transfer the site whenever they want.. it's clearly stated in the ownership rights. there is no point in the trademark names, as diablo or sc or wc, if they wanted, they would point them all to payusallwearethebest.com filled with malware ads.. its just their right to do so

they did not buy diablo3.com, they got it for free, as other similar websites, because they own the diablo trade mark.
so owning diablo3.com would be just an addition to having it redirected to diablommo.com or whatever when they wanted to. owning diablo3.com doesnt probe that they will make it.
