You guys need to learn your Star Trek data - Data will not willfully cause harm to a member of Star Fleet even if they are are an immediate threat to him.
No, Data won't kill any living sentient being, so long as is own existence isn't in peril, that is hardwired into him. He can cause harm to other members of Starfleet, although he often elects not to, because his goal is to be friends with everyone, not their enemy. With that goal leading towards being able to do his own work more efficiently as well as learning how to become more human.
You're both a little off. Data has legit free will, though he's as lawful-neutral as they come (to borrow an D&D convention). He has fired a lethal weapon upon a living sentient person when his existence was not in peril (though deus ex machina prevented consequences arising from his action).

I grew up gaming without internet forums. The entire phenomenon of being upset with a game developer makes no sense to me. No sense. I cannot imagine spending my time and energy being upset about something I choose to do for recreation.
What are the terms of engagement, and versions of Spock/Data?
Spock at his best Vs. Data at his best in an arena death match? Data. not even close.
Most up-to-date time-line? Data is already dead, so Spock wins due to forfeit.
Duel of intellect? Spock wins because he has the dual capacity for cunning and logic.

Except Data doesn't really work that way. His most defining characteristic is being unable to think like a human. Spock, being half-human, can.

You forget that in Star Trek: First Contact it was established that Data can turn his emotion chip on and off at will.
And YOU forget that ın Star Trek: Insurrectıon when Data was malfunctıonıng ın the begınnıng of the fılm, Pıcard asks to Geordı, "His emotıon chıp?" And Geordi was lıke, "He dıdn't take ıt wıth hım."
