Thank you for all the reply. As of this moment, All the emails that I have been getting is "The account is already upheld". I don't know what that actually means, maybe it's really banned. I won't give up. I'll keep on sending those tickets.
Blizzard claimed that I was botting, where as my account was not even logged in at the time of the ban. that the account wasn't even active for months and months. and I have only been playing the game again for about a week, with friends mind you.
I know Blizzard made a mistake, to all of the Blizzard fans out there telling me that their "warden" or "GMs" are 100% accurate, I tell you this, I know they made a mistake. Because I have read a lot of posts and experiences that they got banned for no reason(im not saying that I believe them or anything) and...I got banned for no reason. Or even if there was a reason, it is unjust to get a permanent banned where I didn't do anything remotely close to hacking or botting.
I will keep on fighting.

2. there are pretty much three options:
- you're lying and you did make use of third party programs, sure you never used macros or anything?
- you were hacked by a botter
- you were banned by mistake (rather unlikely)
the only ones that can help you are blizzard employees, given the amount of times you already talked to them and are still banned; two and three are pretty unlikely.
3. why even bother posting here? nothing you will say or post here will prove anything. the video you posted is at best just a confirmation you weren't botting 24/7, nothing else.

Filing addition tickets will NOT increase respond time (in fact it slows it down.) The correct procedure is to file one ticket then wait 48 hours and if it hasnt been answered call them and let them know that your ticket hasn't been aswered

I had my account banned for the same reason, but they never did anything wrong. I sent several tickets and called for the support but always received the same answer. Researching the case found numerous people that were banned in the same way on 22 January.
I would get the money u spend on AH back via paypal... and make a conflict. Try to Call write Tickets do everythink u can ... just as much as u can maybe u get someone who can help u.... which server u play? Eu / US?
I can't the money back because I use my Credit Card. I play on the US Server.
blizzard only ban for botting or third party software use in banwaves, a few days ago banwave hits to AH botters only (not DB or "play" bots). I took banned my 2 ah bots accounts too for botting but i have 2 new bot accounts + € xD

Funny thing is,if you saw the youtube link of my video,(posted on page 3), I received a lot of messages on youtube that they were banned due to third party application usage aswell. So it's safe to say that yes it was "banwave"
With this I am going to assume that the bans were not done by an individual but by an automation script, to ban all that has a red flag on the account.
This could also mean that there might be some collateral damage, assuming their software is not 100% accurate, i mean seriously what software has a 100% pass rate,
Assuming that they have banned 1000 people, 80% of them sent an appeal message, I am pretty sure that they wouldn't have the time to even read our request and appeals. (They might be even sitting down infront of a computer, eating a donut, drinking their mountain dew and laughs at all the excuses they see.)
I am going to say this flat out, whether your a blizzard fan or not. To them(Blizzard), we(Customers) are just numbers...They don't care as long as people still pay for their products.

Macro software for keyboards, mice: Razer, Logitech, etc. That software itself is against the ToS. Whether you used it for macros or not, it is unauthorized 3rd-party software, and not allowed to run while D3 is active.
Mumble: Has a feature that attempts to read a player's location ingame and adjust 3d sound for your voice to correspond to other people's locations ingame. The reading of such memory will trigger Warden and end in ban.
PS3 gamepad on your PC: The software used to make PS3 controllers work on pc = 3rd-party unauthorized. Also features multi-key macro abilities.
And just so we're 100% clear on something. Something doesn't have to interact with D3 to be considered unauthorized 3rd-party software. Google Chrome isnt made by Blizzard, thus it is 3rd party unauthorized.

@Weunis -- I was also banned mistakenly during this wave (I posted a thread here). And I am trying hard to figure out what bug in the warden would have caused this. Your list is helpful, to give me ideas. I don't use any of the software that you mentioned (LootAlert, mumble, etc). I just have a plain 3-button mouse. However, I do have a G15 keyboard. Its not set up with any macros, I am only using it like any generic keyboard. But I guess it must have some process in memory to process key clicks. Do you think this could trigger the warden? I also frequently alt-tab out of the game, and do other things. I play the game with Skype running. There will typically be one or more browsers running, for various reasons. Plus whatever other programs I happen to be working on at the time (say, MS Word, Git Bash, etc.). And of course there is AVG (my anti-virus program) active as well.

While from a purely technical standpoint, all of the above are 3rd party unauthorized software, as it pertains to D3's ToS, there is some line of reality to be drawn.
Antivirus wouldn't likely be a suspect. Word also highly unlikely, but not impossible.
Internet Browser not a high-value suspect, but browser plugins are a different thing altogether.
Skype is also a very unlikely suspect, barring the possible exceptions of Skype's "extra's" apps.
Something else to consider is Windows "sidebar gadgets".
MSI Overdrive, AMD Overdrive, RivaTuner, etc are middle-ground. They do access memory for some purposes. RivaTuner even has support for plugins, and god only knows what those are capable of...
But on to the REAL issue here - you will NEVER know. No matter how much you beg/plead/grovel, Blizz will NEVER EVER EVER EVER EVER EVER tell you what/why exactly triggered the flag and subsequent suspension on your account.
If you were really incorrectly banned, the reinstatement would have happened long ago already. By that I mean, it would take no more than 2-4 tickets to get it sorted. Beyond that, you just need to (as I already said) "get over it" and move on.
You were actioned for something on your PC. It could be a trojan/virus/rootkit/etc from some source that caused some amount of memory interference/scanning or even a hacker using your account to bot without your knowledge.
It could be even more stupid in that you used a friend's PC just to quickly check an auction, or post a bid, or something similar and his PC had actionable processes running.
Bottom line: After 4 tickets you should stop and look in the mirror. Clearly there was no mistake and something does actually exist somewhere in your system that triggered Warden and upon review, warranted a permanent suspension.
To put this in better perspective for you: My own personal experience is as follows
I was actioned for Botting/Automation.
The ban was for 48 hours, as it was my first offense.
Upon ticketing and admitting that I use a Razer Nostromo and made a macro to hold shift+click in one button, I received a response thanking me for my honesty, and that my account would be reinstated early.
A warning in the same message also stated that if I repeat the same offense in future, it would be a permanent ban with no possibility of reinstatement.
Take that as you want.
But NOBODY gets banned for small shit, or false positives right off the bat.
A short suspension is the norm for first minor offenses. The only actions that get instabanned are confirmed botting, cheating, hacking, or otherwise severe interference with the service.
So if you're wondering why people don't/won't/shouldn't ever believe the "I am the most innocent player on the planet and got permabanned for nothing" routine... your answer is in the procedures.
You can even go browse the website to read up in detail the ToS etc - the procedures and penalties are quite clearly outlined and followed to the letter.
You've vented the frustration (I get it, must feel terrible if you didn't do anything wrong). Some people reacted poorly, based on what they believe to be the obvious truth (that you're botter). Some have given you advices, and I thinkyou have tried nearly everything possible.
Right now, there's not much left to do here. So I'll lock the thread before it gets derailed or grounds for some flame wars.
