I find a reasonable opinion to have here is: Everybody that buys the game can do with it whatever the hell he want's (as long as he doesn't deny blizzard any money, assuming there is no monthly fee). And of course no other people are harmed.
You left out an important reason. If its against the terms of service and/or license agreement, you can't do it.(legally).
I personally wouldn't play 99% of the mods out there for most games, including the D2 ones, allowed or not because i don't enjoy them. However i don't have a problem with them existing, if people enjoy it and its allowed, more power to them. The simple fact of the matter here is that Blizzard will almost certainly make it an violation of the EULA and TOS to use any 3rd party mods or UI addon's. If you go and make an add on or mod and run on an emulated server, you're EULA is no longer valid and you have no(legal) right to play the game anymore. This is how licenses work. You do NOT own the game in anyway, what you purchase is the right to use the software in the way that the publisher sees fit. End of story, like it or not.
That being said, there will also almost certainly be an underground collection of private servers and mods to the game that operate under the radar, it will just be illegal to participate. And we all know how well people follow the law when it comes to digital rights...RIAA anyone?(no I don't support the RIAA, but i understand that they have the right, legally, to be douchebags and sue your grandmother for downloading a MP3.)
@falcompsx: you're right, but that's the point I was trying to make earlier. Some people are saying that Blizzard's attitude hasn't change, they haven't supported mods in the past, and they're maintaining that stance. But that's just not true. In the past they didn't support them, but they certainly didn't oppose them. There were a few very high profile mods for both Diablo games that were certainly not under the radar. Blizzard had to know about the. In fact, I can recall some interaction between someone at Blizzard and one of the big modders, but I can't be arsed to look for it, so don't quote me on that. Point being, the mods were well known (at least a couple of them were multiplayer as well), and Blizz knew about them, and did absolutely nothing. Didn't care one bit. But I guarantee you it's gonna be different this time around. They're gonna care, they're not going to like it and they're going to do something about it. And that's the point I was trying to make: where before they were indifferent to mods, they will now actively opposing them. At least that's how things are shaping up, in my view.
By that logic, blizzard knew we used cheats. They didnt do much to stop it, thus they were ok with it.
Its such a laughable stance to take....the fact of the matter is that it was not profitable to fix said issues.
The game was old, the money all but dried up, and they could not really stop it.

One is never hurt by being given additional choices, only by taking them away. A QUADRILLION MAGIC FIND is worthless if you can't kill shit!
Is this really surprising, seeing how supporting modding, will make it that much easier to cheat/bypass some restriction Blizzard would have to put in place.
Also even if Blizzard wanted modding, with the excepition of map editing, modding wouldn't be an easy thing to allow(they would need to design a ton of internal systems, to handle the temp mod istalation, it would be a nightmare trying to design such systems), since almost every aspect of the game, is serverside.

I think its the huge sense of entitlement people have these days. Blizzard makes the game, you buy the game, if you like the game buy the sequel. Then it became: Blizzard makes a game, you buy the game, point out flaws/best points of the game, they fix some of the flaws and enhance some features for the sequel. Now it's: Blizzard starts developing a game, people DEMAND a game be the way THEY wanted it, the game comes out, people buy the game, then they DEMAND the game be "fixed".
What ever happened to enjoying a game for the game? Now people think that they know how to make the perfect game, and disregard the YEARS of coding spent to make games. When someone makes a movie, or writes a book do you demand they fix it? Do you tell them what has to go into the next one? No, you read/watch it and enjoy it or hate it for what it is.

Yea I don't get these people, if I hate a game, I just say screw this game, and I move on. like you said love or hate it for what it is.
With all the time the modding community spends screwing around with making mods, they could make their own game.
There gonna be mods. It's just they will require an emu or private server. Not much different from other mods where you couldn't play on the official Battle.net
I don't understand where all the fuzz come from...

There were some amazing D2 mods, such as Median, Eastern Sun and many more. And that is only the playing aspect. I learned alot about assembler, while modding back in the days, it was a blast.
The EULA is a US thing. It doesn't apply in most other countries. For me there are no legal consequences based on the EULA. Of course if Blizzard doesn't like what I do they will obviously just delete my Battle.net account (and I can't do anything about that), so it is in my interest to behave. This is just theoretical.

Most European countries have laws that protect copyright. It is those that safeguard Blizzard, not some flimsy joke of a licensing agreement. Of course the U.S. is also a leader in anal copyright laws, but many countries would uphold publically distributed software modifications as breach of software copyright. (Not to mention alot of those mods using ripped graphics from other copyrighted games like Bioware/Interplay.)
And group #1 is blizzard, and they already made up there mind years ago.
It is already quite too late regardless.

I think you are missing something, though. Yes, the company makes the game. The players, however, are the ones who pay for the game. The company has every right to make the game howeveer they want, this is true, but the company also must understand that if they do not make a game that their players will want, they will not make money.
Additionally, it was the players that kept Diablo 2 alive for 10+ years, not Blizzard, just like it was the players that keep Total Annihilation alive, despite the company that made it going belly up.
If Blizzard cannot cater to it's customer base, then it will flop, regardless of how much the small section of diehard fans love the game.

Some do, others don't. Copyright is to protect the owner that others don't make cash with their products, which isn't the case for non-profit projects. There's so many laws in different countries. I'm just saying we have to be reasonable. Laws that limit education or creativity where nobody is harmed or loses money in the process in my opinion are bad. There have been D2 Servers running for years, which are non-profit, and there is no case to be made there, because honestly, Blizzard loses nothing.

I'm sorry, but who's demanding anything from Blizzard? All I want is for Blizzard to stay out of modders' way like they used to, instead of this corporate bullshit we're seeing now. All I'm 'demanding' (to use your terminology) from them is inaction.
The problem is you think you deserve it just because you want it. It's Blizzards game, they will make it the way that they want to. You either play the game, or you don't.

No, it's more like saying if you were to somehow get into the data file of a book that went out to all Kidles and you started to dick around with it. Changing words and effectively altering the book for others that may not like it or want it. You could potentially write something better than the author but I highly doubt it.

First of all no one is denying its Blizzards game and they can do whatever they want with it, however lets not make of devs gods - everyone has the right to criticize their mistakes and design shortcomings. Its not black or white "either play the game, or you don't." We can play alright, and we can criticize just as well, no game is perfect, but it can be closer to perfection with superior mods.
Case and point - we KNOW that community can come up with MUCH superior UI than Blizzard's devs can in WoW (which UI design is almost the same as Diablo's). We know spam is a big problem Diablo games too, and community anti-spam mods are MUCH superior to whatever devs can come up with, and can react MUCH faster to circumstances compared to devs.
There are loads of examples how community makes Blizzard's games BETTER and more ENJOYABLE, even devs themselves copy mods and implements them in design later. Thats why Blizz decision to ban all mods was disappointing, and we have 100% right to criticize it.
Criticize all you want but it's your OPINION that the mods make the game better. I'm perfectly fine with a vanilla D3 just like I was with a vanilla D2. You can criticize to hell and back but the devs are the gods of Diablo 3. If you dislike the product so much (before the release of the game, none the less) then don't purchase it. Just continue playing and modding D2.
Yes its an opinion of MAJORITY of serious gamers that mods make Blizzard's games better and more enjoyable. Because standard UI, spam filter (if there will be one in D3), etc. are inferior to communities endeavors (never seen an evidence to the contrary, in any Blizz game), and only fanboys cant see that. Same as your suggestion that if anyone dares to criticize your Blizzard's gods, shouldnt buy the game at all
By no means am I a fanboy of Blizzard, the only game I like of theirs is Diablo, but to tell them that they should make the game the way you want it is what is ruining the gaming community. Having a voice be heard is one thing but being "outraged", as many of those who claim to be modders/love mods, claim to be is obnoxious at best. As I stated before, even though I don't use mods I have nothing against those who do, but it is ultimately their decision how to make their game. If their game mechanics are so broken and "inferior" then why do you play them? Games such as Call of Duty are being ruined because Activision has decided that everyone who bitches deserves to be heard, so they focus more on that then they do advancing gaming as an art.

You definitely sound as "Blizzard can do no wrong", and thats not the stance anyone objective would take. And no, I dont "demand" anything, nor I say everything community says should be in game. However mods are WIDELY spread common sense phenomenon, greatly endorsed by community, in ANY area. Even OS and programs now offer customizations, what to speak of games. Even if you dont care about UI adjustment to your liking, you would lie if you'd say dont care about spamming, and its a FACT devs dont come even close to community anti-spam filters.
P.S. What mods have anything to do with game mechanics? I'm not sure you even understand what mods do, and what I even write here.
A game mechanic is a functionality in a game, such as chat, user interface, or even character progression. And on top of that I never said Blizzard can do no wrong, I am saying when you play the game it should be because you like the game for what it is, not for what could be done to "make it better".
Every D2 mod, and D1 mod I have ever even attempted to play was horrible.
Diablo 3 will hopefully never be modded as it should be perfect the way it is.
UI modification is also almost pointless, its Diablo you do not need to know how much "dps, threat, etc" you are generating. Let alone the fact that all the hot keys you can have and shortcuts are already presented in the real ui. What more info do you need. Lets not over complicate what diablo is and pick up our mice and start clicking away please.
The irony is that many of the new features that are included in Diablo III were already seen in multiple mods over the decade. I think that says something. If they thought that such additions were improvements, than, by Blizzard's very own consent, such mods were improvements over the original game.
I agree with UI addons, though. With the speed of the game and the fact that you can only have as many hotkeys as are displayed on your GUI, they are pointless. But they do have DPS displayed in your character screen in-game. Just FYI.
Mods have their own cult followings. There's plenty of players that never go back. I think it's a shame that in this age of player-generated content, Blizzard isn't following the trend, since it's obviously profitable.

Uhhh... MAJORITY of serious gamers? Sorry but there are a lot of gamers, serious gamers who don't use mods or prefer to use as few mods as possible partially be its too much trouble or we prefer to play the game as developers intended.
If you are able to mod D3 without the developers putting in any tools or effort to make data readable to you. I say go for it, more power to you. But in no way should they spend any time or effort supporting modders because it has no direct benefit for them and its not their vision of the game.
And if after you make the mod and intend to share it with others, just know you run the risk of being sued, and/or having your battlenet account terminated because of cheating. If you're ok with that, more power to you and your mods.
