Yes, there are many children mature enough to handle games. I'm sure you are, and I was one as well. But there are a minority who aren't. That is what the rating is for. It is undeniable that the line has to be drawn somewhere, and the age of 17 was the consensus of the big guns in Washington of where that line would be drawn.
That's not a law. ESRB is just a guideline. ESA actually got quite a few state cases overturned because state legislatures tried to put in a law binding age requirement.
