The screenshot and video are probably real, the question is, is this alpha, beta, or just one of the many demo builds? All I can say is I'll enjoy looking at these shots and watching the video then wait tomorrow for a blue post (bashiok confirmed earlier that they haven't sent out emails yet).

guys these look good but one thing u all need to look at in every pic it shows he has 7 health pots. he also has the same amount of EXP and the same skills
I dont really see a problem with that. we can only see, that the wizzard is walking in the town --> obviously she cant kill there a thing, and no need to change anything or use a health pot.

Yeah the one from press events? Also traits are removed they're now passive skills, thats why its relevant.

In a little late: Have people forgotten that there are more testing stages prior to release than Open Beta? There are alpha tests, closed beta tests, open beta tests, etc. This can very well be screenshots from closed beta or alphas.
The login screen beta numbers doesn't match if you compare it to press event beta build.

You must consider that if these are indeed fake and indeed photoshopped, how would a person this skilled in photoshop trickery slip up on such an obvious detail? On the other hand, he could have just missed that detail, but again...
But regardless, I imagine this beta build is the newest version given recently to friends/family of Blizzard employees and was leaked accordingly, or that the leaker is an employee himself (which he claims to be) and leaked the most recent beta build.

The screenshot led me to an action bar question, did they remove the tab for right click? I know that they decrease the active skill from 7 to 6 so the tab was the one that got cut? Also I noticed that he's currently mouseovering the blacksmith and has his name pop'd out. The font at least should be the same as the one in the boxed conversation where it shows the wizard's portrait.

Not quite, but Sixen seems certain it's real. The ex employee story actually seems legit this time.
