if you automated anything in the game with it, of course it is. otherwise - no.
did you alter anything in your d3 folder or similar? extracting information out of them can be enough (as read in the e-mail you posted).
they usually really look into bans first and only ban if they are quite sure about it. that's why it takes some time to ban botters... it's very unlikely but possible, that they got the wrong guy. i cant imagine though, that nothing happened to the game and you got banned - that would be widely known to occur.

i heard about some really really rare cases in wow, where people posted on forums about being banned but innocent... and it always turned out to be justified. i've not heard about it in d3.
i dont want to say you'r guilty - just that it's very rare.

Law > TOU/TOS/EULA/whatever bullshit a company tries to force upon you. At least in every normal country. People are getting a refund even after 6 months just because on some CE game boxes PVP was listed as a feature, and that's false advertising. A correctly formulated complaint to the local consumer protection institution did the trick for them. That's what you should do if (and only when) everything else fails. First and foremost, try to get in reason with Blizzard. Be civil and calm whenever you communicate with them, that will help your cause.

Just for the record, I'd be interested too, if you used keyboard or mouse macros. Anyways, macros that are made with the manufacturer's default software are legitimate, and can't be used as a reason to ban you, though macros can be easily mistakened for other automated scripts...

i'm not sure, this is true... if you can somehow automate things in the game, it's not legal. i cant think about anything in d3, but in WoW a friend of mine used his keyboard to mill herbs or ores for hours... he didnt get banned, but it's basically botting. (he wrote a macro and the keyboard spammed the button for hours)
or a made up example: if there comes a bot with your manufacturers software, it's still not legal, if you know what i mean. that would be a loophole, which is just too easy :)

btw you can macro quite advanced stuff with newer keyboards... :)

If the input driver/program doesn't interact with the game's memory and doesn't alter the game files in any way the macro will be legit. If there's a standard input device from a well-known vendor which might get you banned Blizzard should issue a warn publicly before it bans anyone.

For your example in WoW, spam-clicking a button to mill herbs does not harm the game. Spam clicking a button in a battleground to avoid the auto afk-kick on the other hand, does harm the game, and will result in a temporary suspension (and a ban for repeat offenders).

So what really matters is context. Writing a gear-swapping input macro does not harm Diablo. Starting hundreds of games in a day to farm Sarkoth does harm the game (according to devs at least), and it doesn't matter if you've done it with a chinese farmer, a younger brother, or with a macro.

I hope you have thousands of dollers/euro ready to loose if you try a lawsuit. You will lose and will have to pay for everyones time waste. I think its safe to assume that blizzard do not perm ban accounts without reason.

A: Your lying. And have been using a bot, loot alert etc. Or you have borrowed your account to someone that have.
B: Your one of the few actual inocent, in which case you should contact blizzard and figure out what happent. If it could be malware or keyboard/mouse macro etc

Everyone always claim they are not part of A. But it also shows that like 95% is part of A. Via account sharing or anything silly like that. I hope your a B person and get it streightned out

but nobody can help with the ban here, i think. :(

on the keyboard discussion: i think it's still not tolerated to make the game play itself (be it battlegrounds or automatic crafting in wow). you can write simple d3-bots with newer keyboards too, i think (logout, in, spam ability, out, in...). not that it's really useful...
from the wow-perspective, everything macros and lua (addons) do, is ok. addons that could i.e. mill or prospect for you were banned a long time ago, they cant do it anymore, because it's not programmable.
in d3, everything you automate is bannable, as far as i understand.

Call Blizzard and be polite when you do. Have the email information with you and get the agents name and the ticket number of the call. Try to work with them and see about getting a supervisor to put a ticket through to the email support.

I doubt that Blizzard will ban customers with no reason and evidence. If they do than I see Blizzard be losing many sales since customer will be saying why am I buying this game if they can ban me for no reason. Trust me Blizzard does not want to lose sales since that is all the suits at ActiBlizzard cares about is the money from sales.

Just having them?  Nope, that's cool.  Using the macro software or built-in macro functions?  Absolutely.  You are not allowed to use any macro'ing at all, in any way shape or form.  This isn't WoW or any other game.  If it's not build directly into the game, it's not OK to use.

Actually, macros are allowed, and here's the confirmation I got from them, after asking them, after I've seen this thread and started to get paranoid.

Recently, your account was actioned incorrectly as a result of our efforts to protect the Diablo III environment from exploitative behavior. As part of these efforts, we recently closed some accounts engaged in or associated with exploitative activities including the use of third party programs.

It is really cool to see that they actually care about their customers. They have a huge playerbase and in that case, mistake can happen. Glad to hear you are good to go!

Well, you were unable to play for a couple days, but if it is the tax for trying to get rid of the botters and actual abusers, who ruin the game for us others playing according to rules, it wasn't that bad, right?

Tbh if they withdrew the ban after 1st appeal I would say it was ok, but he complained against the bann and they answered "we looked into it, you where correctly banned" and it wasn't changed until his 2nd appeal.

Unfortunately it's not the first time I have heard people getting that 1st response only to get it corrected after 2 or more appeals. It seems those 1st line GM's don't have all info so as far as they can see it's a correct suspension or ofc it could be that some GM's are lazy or simply not that good at their job so they reply with " We looked into it and we where correct" and hopes the problem goes away.
