Those jobs were available prior to the petition's posting (to my knowledge). However, if we were the cause of that...I would have trouble containing my laughter.

Various factors come into play when you take relocation into consideration, such as money, family/friend ties etc. Hell, I wish to work for Blizzard one day (I bet you can't guess for what department) however if I have to move up to Irvine, I may have to reconsider.

3D design with programs like Blender and 3DS Max doesn't take an awful long to get a hold of ;)
For a couple of games i had to make some models, pretty scrappy as i prefer code :P but i am sure people who have a desire for desiging and stuff could be pro in no time.
*Note* Blender is freeware and 3DS Max is not, though a little birdy told me that warez can help you there!

If you heard what Rob Pardo said in an interview they have an act or two done and all the classes are playable. So it really isn't that far from being completed. The only thing that will take time is perfecting it, so playing it once through and making sure all the monsters are storng enough to be of challenge and so on, simple things like that.
Also majority of the jobs are design based, so its really all about the graphics and visuals seeing as the engine and physics have been implemented.

I'm an artist and I have to deal with freelance clients that make the worst design choices imaginable and force me to execute them if I want to get paid. I try to educate them a little about design, 'first read', simplification, color theory, etc...but they want what they want. So often I end up with stuff I wouldn't use for my portfolio. And I doubt they are as happy as they thought they would be either. And not because I didn't do a good job but because they just couldn't imagine the final product as it will really look. But I often can't convince them ahead of time.
I think the same would be true here also. You'd not like the game if it was hard to tell the mobs apart or there was only one mood for the whole game. If it was all dark and gritty and desaturated, they'd have to make other compromises like making less variety of mobs to be sure they all stand out enough to allow you to tell them apart. Or they'd have to dumb down the gameplay so it didn't matter what mob you were fighting. I don't think you're listening to the reasons they give for the more colorful design. And I haven't seen one logical reason for making the game less colorful. All I hear is "it's not the way it's supposed to look!". That's just opinion and doesn't help the designers make a better game. You just want what you want. But the game would suffer for it. Luckily Blizzard doesn't have to do what the stupid client wants, they get to make the game the way they think is best. They've done pretty good so far by all accounts.
Turn your gamma down or adjust your monitor when you play D3. But please stop wining about the art with no other reason then "because it doesn't look like I think it should".
