Because Blizzard kicks ass with their games it's inevitable. There is a whole market of retailers ready to resell offline copies.
This is not the case. Multiplayer depends on the original balance in WoW, but in Diablo it won't matter.

Instruction for Win7/Vista/XP: press WinKey+Break(pause) > (Advanced system settings for 7/vista) > System Properties, Advanced tab > Performance, Settings button > Performance options, Advanced tab, Virtual memory, change button > select "No paging file" and press Set button for every disk, reboot and see for yourself.
In case you don't like what you get, you can always set it back. I do not recommend this if you have less than 6 Gb of ram, since you'll be experiencing problems if you run a lot of apps simultaneously (you will eventually do that and it's gonna be frustrating).

If you have lots of ram (more than 6 Gb) and you don't run VMs like me, you may want to disable your swap file completely so the OS takes everything from ram. You'll notice much better performance and loading times decrease, a lot like running from SSD, but when you have both, mmmmm…
