Max Shcaefer was a lead designer in D2 and partially early stages of D3, so it's natural that he'd want to steal some of the newer ideas. Seems sort of spiteful. Then again they're good ideas so why not.
They were not meeting Blizzards standards apparently.
On August 1, 2005, Blizzard Entertainment announced the closure of Blizzard North. A key reason for the closure was Blizzard North's poor development of what was to be Diablo III which did not meet the expectations of Vivendi.
Schaefer went on to hop to Flagship Studios working on Hellgate: London, and Mythos and when that began to sink, Runic Games.
I dunno Torchlight is pretty fun for the money spent. Torchlight 2, hopefully I'll feel the same. It does seem like a watered down version of Diablo 3, but with mods, and you pay less. So it sort of equals out in some way in my opinion.
I like at the end of the video when asked when it's coming out. "Hopefully before Diablo 3"

As far as I know D3 50$ like all PC games, and Torchlight said something around the ballpark of 30$.
