Can't unless the Supreme Court gives the OK to sue. Apparently.
For all the shit America gets, at least we aren't legally gimped yet.
It's written on pre-order reciepts that they are non-refundable. Sure it may be immoral, and in sticky situations or if someone changes there mind then giving the refund is a gesture of goodwill, but they can't refund. There is nowhere for the money to come from. PWC is in charge of admin for them now. It would be intersting to know if when the heads knew about the impending drop into administration, wether they told other staff, or wether they allowed their stores to continue to push for pre-orders that they knew they could not fulfill
That doesn't matter. You can still sue them in our country.
Money paid + Service not received = Stealing.
Period. You sue them, you win.
There was somewhere for the money to come from when they took your money, and that was telling you they were insolvent and couldn't offer the requested service. They literally just used you as their own private free paycheck on purpose. Corporations are, legally, people. They can be held to the standards of your neighbor.
If they're open and they have employees, fire them and close the store. Bingo, you've got some money. It's not rocket science.

What do you mean there is nowhere for the money to come from? They basically just took the money for nothing in return. Where did the money go?

As shit as the situation is, I'm glad that it wont lead to litigation to be honest. Litigation fucking sucks balls (speaking from working in the medical proffesion). Litigation rates are much lower here and I prefer it that way. 70% of internists and 99% of specialists in the US have been sued (wether successful or not). It's just ridiculous.
im pretty sure they must give you a refund or they will end up in BIIGG fken shit!
They don't. Companies that go into Administration because they are bankrupt do not have to honor pre-orders. Heres some more info from the Kotaku (http://www.kotaku.co...-on-pre-orders/):
Technically, with GAME going into administration, consumers with paid pre-orders have become unsecured creditors. The Corporations Act determines the order that creditors are paid, and unsecured creditors are generally at the bottom of a long list.
If you paid with a credit card, you can dispute the payment itself and possibly get it back.
I wonder how people asking for a sue think you can sue a a company in bankruptcy ? Bankruptcy means you cannot pay your debts anymore.
Its not that they don't want, they can't and corporations have limited liability to make things very hard.
The company just owe you, but cannot pay. If its so bad that the company must liquidate, creditors are paid in an order of priority, I'm pretty sure consumers are at the bottom of this list while banks are at the top.

To reduce their debt I guess.
