nobody's after bail, no one's in jail. if you mean baal, all i know is from what i learned in the games. the horadrim encaged him in the desert within tal rasha, and he was set free by the wanderer/diablo. then it was our job to hunt him down and destroy him.
in the sin war books they only use the different names to not tell people that they actually are the three prime evils.. they are trying ton convert people and at first they tell them the names of the three lords are Mefis, Bala, and Dialon; after the people are fully converted to the Temple of the Triune they reveal the truth about how evil the temple really is
(I have no doubt in my mind that Diablo will find some way to return eventually)
Naturally. Diablo has at his disposal the power of clever writers who can summon unlikely plot devices which allow Diablo to return bigger and badder than ever.
I know this is a little off topic, but hey here I go.
I just finished reading Constantine and watched the movie, and forgot about how the Lord of Terror has a son named Mammon. You guys think Blizzard could involve him in the plot somehow? Could be interesting.
And in the Sin War books he and the other Prime Evils are referred to by slightly different names.

What are these "names" you speak of?
