if your banned for a macro - then anyone using g15+ keyboards, zboards, naga mice and so on - should also be banned then;
Not a question of "should", but rather "can". A little macro that improves quality of life of players "should" not be bannable, but unfortunetly, it "can".
It's a macro that makes swapping on your magic find gear a little easier. Yes, I can already do this manually because the game allows me to. Here's what needs to happen.
Blizzard needs to come out against swapping in to MF gear at the last second.
Make MF gear have no effect unless you put it on before combat with something.
Make it impossible to equip MF gear when you are in combat with anything.
Blizzard needs to endorse it and allow you with their systems to swap between two gear sets.
Until then people are going to swap on MF gear either manually or with a program. Blizzard just needs to take a stance on whether or not putting MF on at the last second is intended behavior.

They already did come out against it - there was a blue post awhile back where they clearly stated they decided not to include a weapon switch similar to "w" in D2 because too many people were using it to effectively cheat the system and do the damage granted by their dps gear but also get the mf bonus granted by their mf gear.

Did I say that it was WoW? Obviously there's some mechanics that work with elites where they know to chase you and not sit there and regen to full. Obviously the game will know if you are in combat with a boss simply because you are in the boss event. People are swapping to MF before an elite pack died, and before a boss dies. The boss is easily detectable, and elites should be simple enough to detect.
Even in a boss event there is still no such thing as "in combat." If you wander far enough away from a boss in one of the bigger rooms it won't always follow you and find you. I've done this a few times with Diablo, Azmodan, the SK, and a few others when I needed some time to let my potion come off cool-down. I suppose you could just make all gear swapping during boss events not allowed, that would have nothing to do with being in or out of combat.
There is also no such thing as "in combat" with elites. Yes, they will chase you, but that's simply because you changed their state from "idle" to "active" by damaging them or coming too close to them. If you run away fast enough and put enough distance between you and them, they will stop chasing you and stay put until you come close enough and once again change their state.

They just need to have the MF % not update until x amount of time after you equip it. Personally, I think 60 seconds would be long enough to discourage most people from switching MF for rare packs and chests.
That said, I personally wouldn't take the risk.
