Not sure if everyone's seen this by now but it's one of the more impressive things I've seen from a company in awhile. An Australian retailer named GAME filed for bankruptcy and informed customers who had pre-ordered Diablo 3 that they would not be able to fulfill the orders.
The biggest kicker though was that GAME wasn't going to refund their deposits either. There are other posts out that which describe why/how this is actually legal but was still pretty crushing for those unfortunate gamers. Now, however, they seem to be in luck.
Blizzard just announced that customers who pre-ordered through GAME can purchase the digital download and have their costs refunded (providing that they have a valid receipt). Considering that Blizzard was under no obligation to do so makes this all the more amazing.
Pretty impressive to see a company go out of its way to ensure that their fans can enjoy the launch of D3.
Blizzard is the present and future of gaming. I don't know of many other companies, especially massive companies, who interact with their community and consistently go above and beyond expectations in their games and random events.
Good to have this news from Blizzard, despite the obvious financial benifits on a release day, this is the best gesture I've seen from a game company and I guess that's what make Blizzard special.

Should, but can't be. While under Administration, legal action by creditors (regular and unsecured alike) cannot be taken without permission from the Supreme Court.
Besides, they have no money left. There would not be much you could sue for anyway.

Well done!
I'm happy for those who were unfortunate, at least they won't lose money or Diablo 3.
And fuck GAME. They should be sued for that.
