I think they should STRAIGHT UP install hardware-random number generators on their server sides, like a lot of them, and then use those for item drops. that would be epic.

Some high level items will be BoE, where once you equip them you can't trade them. So you'll still be able to trade your gems and everything, just not stuff like legendaries or very high level items.
Blizzard said a few things like quest items will be soulbound and I can't find it anywhere them saying items will be BoE.
i recall them saying some items will be BoE. i personally think there should be a counter, like Bind on Second Equip so you can atleast try it once before selling.

Well its not like you take off your gear all that much after the first time putting it on. So it would have to function quite a bit differently than that. And most of the time its just a straight upgrade of stats so you won't have to try it in order to know if its better/worse.

but if your max level, with decent gear and find a nice sword. Dont you want to TEST how it looks, works etc before deciding to sell it?

Well you'll have to know how much you could trade it for and what kind of stats you're looking for. And as far as looks go they could easily have something where you can see how an item looks on your character before equipping it. And as far as functionality, its not like one sword works completely different than another. And even if they did, making such an easily exploitable system to allow people to test things out would be pretty bad imo. It would just make it so that some people could get full use out of an item before trading it, even though its designed to be taken out of the economy once you use it.
Agreed; a "bind-on-second-equip" would be extremely easily exploitable. Even if it was a "bind-after-x-minutes" would be exploitable because people would write scripts to re-equip stuff so they never become bound. I don't think BoE is so bad; they did say it was going to be mostly end-game stuff. It'll just become a "risk" if you aren't sure, and everyone will get used to it eventually. And later on, I'm sure there will be a site like The Arreat Summit that will show how weapons and equipment look on different classes.
My rule of thumb: If you're unsure if it will be an upgrade, attempt to sell it first.
How about it only binds if you're out of town? So you could try the item on in town, check out how it looks, watch your stats go up etc. If you left town it would come up with a prompt. "Do you want to bind this item to your character?" then it would put it in your inventory if you select no.
