Items that are called "Unique" have exactly one in the entire game universe. Only one player gets it, and it cannot drop again while in possession of a player.
These uniques have a timeout of one week real time. They display a countdown timer, showing how much time remains. Tick, tick, tick...Get your mileage while you can...After that player's week is up, the item vanishes, and can drop in the world again.
There can still be Legendary and Ultra-Rare stuff, which are not unique -- there can be as many of those as the random drops create.

I like everything about what you say except for the 1-week thing. To have an item for a week is kind of pointless. Not a big fan of that 1-week thing at all, but i like your 1 item in the universe of diablo or per realm idea.
Why a week timer? Imagine if someone got a unique and then stopped playing. Or just hoarded them off the trader so no one else could have them.
It could be more like a power-up. Maybe the the unique isn't the item itself, maybe it's a temporary socketed gem that fades, leaving a good magic item with an empty socket after it's gone. That way there's a collectible memory to go with it.
By letting everyone get 'a turn,' it introduces a pseudo-social dynamic
that is usually not present in these games.
EDIT: Otherwise the first guy to get it keeps it, and no one else ever gets it. And they'll do anything to keep it, including putting it on the trader for a billion gold, sticking it in email, passing it to a mule alt, storing it in a one-man guild hall, and visiting their toon just to refresh the timer.

no thanks.. if theres gonna be ladders thats just retarded some guy could go dominate in pvp.. diablo 3 is going to be about equality while still being very diverse, that's my impression anyways.
I like this idea, including the 1 week timer. It could add an interesting dynamic to the game. 1 week should idealy be about the time it takes an average gamer to beat an act. Ladder players will get a tiny bit of use out of it, but I am thinking that the average Joe will benefit more from it.
And if I were to get one of those, I would show it off everywhere, but I would never trade the thing, especially if it is gonna poof in 1 week.
Actually, I would probably be too busy trying to beat the game on Hell with the item rather than sit in trading games.

Using a armor worn by millions of players is something natural. In diablo you don't we will never drop all the gear you need alone. So trade is something natural.
How about a rare boss that spawns in a tough spot in Hell difficulty that drops a particular unique only available from killing it? Like maybe this boss only spawns once every 2 week period or so.

Hmm, 1 in the entire 'universe', sounds interesting but wouldn't really work out. Because, in this game where you are the powerful hero(and can play with others online as a co-op, but still starring you as the hero who does it all in the storyline), it doesn't make sense that you can't find the best stuff and whatnot.
Now, if u made each unique item exclusive to the player, and you couldn't get more than one of any unique, that would work better.(players with multiple 'stone of jordan'...don't make sense).
OOOOOO this sounds really cool, but i must agree with tenaciousg... so the fix... is treat this wepon like guild wars treats some of their skills... in PvM it has certain stats... but in PvP it will be have the stats as a weapon that everyone has access to.
