Considering Blizzard won't ban an account until they have complete proof, I'm going to say you were doing something wrong, which could have been as simple as a keyboard macro. Mistakes can always be made, but I'm going to err on the side that you were doing something wrong.

And one of my goals is to figure it out so it does not happen to any other people.
My name is Gino. Sadly, on January 22, 2013 my Diablo 3 account got banned. Blizzard claimed that I was using a bot or a hacking tool. I wrote them a ticket and even called them multiple times still no avail.
I am not typing this to ask for any sympathy, I am not asking you to believe me that I am innocent. All I need is an advice and help. I know I am innocent. I have not used any software that can bot nor hack.
What's trouble some is , Blizzard will not tell me what triggered their counter measure so I could check weather I have it.
I feel with ya.
Last Week my SC2 Account got perma banned for hacking / exploit.
Funny Thing is... i dont even have SC2 installed since over a year.
Wrote Support and explained everything... they dont even listen.
I had digital HotS CE preordered, and canceled it due to the ban...if they dont want Money, thats fine with me.

Fuck this Company, serious.
Yeah, I have my diablo 3 uninstalled for the past many months since it came out. I just recently installed it on my new SSD last week. After playing for about a week. I get a ban. LOL. wasted my time playing this. and trying to prove my self that I am innocent.
Whats funny is, I was in a party most of the time playing this game.
It's not about my account, nor the money I have invested. It's about whats right. about justice. Its about letting the world know that there is a company that is so unforgiving, that doesn't listen and that doesn't care. If we don't stand up against a tyrant...then pretty much we live f****ed up world where gamers who bought the game and who are innocent has no say whatsoever.
The problem is that Blizzard can't really tell people much about why there were banned, as that just gives legitimately-banned people more data to help them iterate techniques and get better at messing up our game.
I can only recommend that if you're trying to get your account back, be polite, be persistent and be honest.
It'd also probably help to not confuse "listen to" with "obey" either, but that's a very fine distinction that has troubled philosophers for centuries. Apparently.
I have no idea if the OP is lying or really is innocent, but to the people who automatically assume anybody banned and claiming innocence is lying, how about this for you:
My friend didn't log in for two weeks around Christmas. Shortly after the New Year he logged in to find his account banned and an e-mail from Blizzard telling him he had been banned for third-party exploits, or something like that. Trust me, he wasn't botting or doing anything against the rules (he's too much of a computer idiot to even know how to). He appealed over and over and kept getting generic form responses about his appeal being denied and account action being upheld, but he persisted and kept sending tickets demanding an explanation. Last week his account was reactivated with a one-sentence reply that, upon further review, the account action was being reversed. No explanation, no apology, nothing. Just a reactivation.
They screw up sometimes, and often refuse to take a second look until you literally spend weeks sending dozens of tickets.
Blizzard does not go around falsely banning people for no reason, I swear to you, they wouldn't ban you if you weren't exploiting the game. I openly admit to botting, and i've paid for botting a lot especially in Diablo 3 and they have 0 reason to tell you why you got caught, with what software, and they own everything that you got, its written in the ToS that you accepted. Simply have to make up for your losses and keep on truckin'....
With that said, if you sincerely did not bot, then you must have been hacked; and you should start with account recovery, instead you plead with GM's who won't read your tickets and send you automated messages.
You can't keep sending tickets because they'll eventually just close your tickets, so you're out of luck man, move on like we all do.
I know that blizzard bans for reasons
Sometimes though they just aren't good reasons.
I got banned for buying stuff on the RMAH while at a hotel for work. The internet was so crappy there I was in the process of farming the AH but it was a different IP and even with an authenticator I got banned.
I was not happy and it took several days to straighten out.
I ended up having to call in, which i guess they stopped letting you do?
Basically when you call in referance your ticket and ask them to take a look at it.
HINT this will be a several day process figure your not going to be playing for a week or two.
This is not entirely true, as the past has shown us. There are people who get banned even though they're innocent and if you keep sending tickets you might eventually get your account back. Just because you're admitting that you're botting don't assume all the others are, too.
Keep in mind how Warden works, it watches your system and all game files and if something fishy happens you're screwed. It might even be enough to install a questionable "high performance customized graphics driver" or something like that. Or a virus scanner touches one of the D3 game files. Or you don't use an authenticator and log in while you're on vacation. Or, of course, you're doing something wrong.

Not true. Unfortunately even Blizzard mistakes sometimes, and bans people who play only from home and with a physical authenticator key. Most times they'll revert their mistakes after a month or two, but sometimes they don't lift the ban. A friend lost his old vanilla wow account that way. Blizzard's loss though. They lost his and my subscription both, as we are playing other games now.
Thank you for all the reply. As of this moment, All the emails that I have been getting is "The account is already upheld". I don't know what that actually means, maybe it's really banned. I won't give up. I'll keep on sending those tickets.
Blizzard claimed that I was botting, where as my account was not even logged in at the time of the ban. that the account wasn't even active for months and months. and I have only been playing the game again for about a week, with friends mind you.
I know Blizzard made a mistake, to all of the Blizzard fans out there telling me that their "warden" or "GMs" are 100% accurate, I tell you this, I know they made a mistake. Because I have read a lot of posts and experiences that they got banned for no reason(im not saying that I believe them or anything) and...I got banned for no reason. Or even if there was a reason, it is unjust to get a permanent banned where I didn't do anything remotely close to hacking or botting.
@OP: Did you use an authenticator? It really sounds like you got hacked and your account was used for botting. There's nothing you can do then, it's your responsibility to make sure your account isn't used for any bad stuff.
Btw, even though this is terrible news to some of you, but everyone should be aware that you signed the Diablo 3 End User Licence Agreement, including this section:
"Termination. This License Agreement is effective until terminated. You may terminate this License Agreement at any time by providing notice to Blizzard customer service via email at support@blizzard.com, at which time Blizzard will remove your license to use the Game from the Account. Blizzard may terminate this Agreement at any time for any reason or no reason. Upon termination, all licenses granted herein shall immediately terminate and you must promptly remove the Game from your hard drive."
Yep that's right, "for any reason or no reason". It's more or less a service that they even provide a reason for the ban, and it's even better service that they re-open some of the accounts...

Off topic, I like the part where they say you shall immediately remove the game from your hard drive, even though you can download and install the game without having a license.
On topic: best of luck. Just make sure you're changing your tickets some when you submit new ones. If you haven't already, mention the break you took and maybe they'll look at the logs to see if your ban was based on playtime during the time you didn't play. I think in a lot of those cases they do reverse the ban if the logs indicate you weren't the one playing, but I can't say for sure since I have no direct experience in the matter.
I think it's the time when I was playing Diablo 3, and open Guild Wars 2 at the same time. I was with a party playing DIablo 3, and my guild buddies told me to log in Guild Wars for a Change guild event. So I did. Probably Warden thought I was botting with Guild Wars 2 opened.
I don't know I am not sure. But at this point, that's the only thing that I could think of that is remotely close that can trigger a ban. playing 2 games at the same time. on of both games will think im botting or something. I dont know.
And one of my goals is to figure it out so it does not happen to any other people.
