I received and e-mail from Blizzard about 3 hours ago stating that my account has been closed..
Said e-mail stated:
Account Action: Account Closure
Offense: Unapproved Third Party Software
A third party program is any file or program that is used in addition to the game to gain an unfair advantage. These programs may increase movement speed or teleport heroes from one place to another beyond what is allowed by game design. It also includes any programs that obtain information from the game that is not normally available to the regular player or that transmit or modify any of the game files.
I have NEVER used, or attempted to use, third party programs while playing diablo 3. I am not looking for sympathy, I am asking for help as to what I should do, and if it is even possible to get my account back. I hope that I am not wasting my time for something that is impossible. I have submitted a ticket to Blizzard, but from what I have read of this happening to other players, they usually send back a generic e-mail and never disclose what the details of the actual offense are. I am in complete shock, and devestated that this has happened to me.

Maybe your PC got infected and you didn't know it. I can't tell you what to do other than try calling them up and explaining. I dunno if that'd work, but its worth a try.

I hope you didn't click any links in that email and submitting your login information, it might be a scam.
It is truly gone. The letter was officially from blizzard. and when i got to battle.net it shows my account status as "banned"
you possibly got banned by mistake in a bot banwave, it's not the first time this happens. Blizzard isn't perfect and they have banned several innocent players in the past. I would call anyway and give them a talking-to.

...even though the e-mail specifically stated multiple times that calling would do absolutely nothing to resolve this matter, as the customer service reps would NOT have access to this information, or even be able to comment on it for that matter????
Make yourself visible, call them, send e-mails, create a forum post. Complaint to a consumer's protection organisation (dont know how they are called in your region) if they don't listen. You are a paying customer, if you did not break the mutual agreement and they still denied you access to a product you paid for, demand at least an apology.
This could actually be a law-suit, even though a bit comedic, considering how little money is involved here. Even if your computer got infected by virus, it cannot be considered 'using' a program with intention.

pretty sure you'd be laughed at immediately. The ToS is very clear. So you threatening them over something that is ironclad in their ToS something you sign prior to even playing the game...good luck.

Anyway threat is always a good weapon, if let's say you have the power to cast shadow on the companie's name, they would be more then willing to rather open your account then go through the shit.
But anyway, this isn't about legal cause, this is more about Blizzard having a sense of fairness. But believe me, you have the power to convince a considerable amount of people that this is bullshit from the companies part and Blizzard certainly doesn't want to that to happen.

Law > TOU/TOS/EULA/whatever bullshit a company tries to force upon you. At least in every normal country. People are getting a refund even after 6 months just because on some CE game boxes PVP was listed as a feature, and that's false advertising. A correctly formulated complaint to the local consumer protection institution did the trick for them. That's what you should do if (and only when) everything else fails. First and foremost, try to get in reason with Blizzard. Be civil and calm whenever you communicate with them, that will help your cause.
Just for the record, I'd be interested too, if you used keyboard or mouse macros. Anyways, macros that are made with the manufacturer's default software are legitimate, and can't be used as a reason to ban you, though macros can be easily mistakened for other automated scripts...
or a made up example: if there comes a bot with your manufacturers software, it's still not legal, if you know what i mean. that would be a loophole, which is just too easy
btw you can macro quite advanced stuff with newer keyboards...
If the input driver/program doesn't interact with the game's memory and doesn't alter the game files in any way the macro will be legit. If there's a standard input device from a well-known vendor which might get you banned Blizzard should issue a warn publicly before it bans anyone.
For your example in WoW, spam-clicking a button to mill herbs does not harm the game. Spam clicking a button in a battleground to avoid the auto afk-kick on the other hand, does harm the game, and will result in a temporary suspension (and a ban for repeat offenders).
So what really matters is context. Writing a gear-swapping input macro does not harm Diablo. Starting hundreds of games in a day to farm Sarkoth does harm the game (according to devs at least), and it doesn't matter if you've done it with a chinese farmer, a younger brother, or with a macro.
I hope you have thousands of dollers/euro ready to loose if you try a lawsuit. You will lose and will have to pay for everyones time waste. I think its safe to assume that blizzard do not perm ban accounts without reason.
A: Your lying. And have been using a bot, loot alert etc. Or you have borrowed your account to someone that have.
B: Your one of the few actual inocent, in which case you should contact blizzard and figure out what happent. If it could be malware or keyboard/mouse macro etc
Everyone always claim they are not part of A. But it also shows that like 95% is part of A. Via account sharing or anything silly like that. I hope your a B person and get it streightned out
